Common use of Review of Arbitral Award Clause in Contracts

Review of Arbitral Award. Any action to enforce or vacate the arbitral award described in paragraph (a) shall be an action under Section 301 of the Labor-Management Relations Act of 1947, as amended, 29 U.S.C. § 185 (“the Section 301 Action”) and reviewed under the standards applicable to judicial review of arbitration awards pursuant to Section 301. Dxxx reserves the right to commence such Section 301 Action in the Bankruptcy Court.
