Common use of Review of Insurance by Province Clause in Contracts

Review of Insurance by Province. Without limiting Section 2.13 [Review, Approval, Inspection and Audit by the Province], the submission or delivery to the Province’s Representative, and the receipt, review, approval or acceptance by the Province or the Province’s Representative of any insurance policy or any draft or certified copy of an insurance policy or any certificate of insurance, cover note or other evidence of compliance with this Part 6 and Schedule 15 [Insurance Requirements], shall not, irrespective of whether any objection is made thereto by the Province: (a) imply any acceptance by the Province or BCTFA that the extent of the insurance coverage is sufficient or that the terms and conditions thereof are satisfactory, in either case for the purposes of the Project or this Agreement; or (b) relieve or exempt or be deemed to relieve or exempt Project Co or any other person from any of its obligations and liabilities under this Agreement or any of the other Province Project Documents or at law or in equity including its obligations to insure as provided in this Part 6 [Insurance, Damage and Destruction] and Schedule 15 [Insurance Requirements]; or (c) derogate from, limit or prejudice any rights of the Province under this Agreement.
