Common use of Review Process Limitations Clause in Contracts

Review Process Limitations. The Asset Representations Reviewer is not obligated to: (i) determine whether a Group Delinquency Trigger has occurred or whether the required percentage of the Public Noteholders of such Group has voted to direct a Review under the Master Collateral Agreement, and may rely on the information in any Review Notice delivered by the Master Collateral Agreement; (ii) determine which Group Receivables are subject to a Review, and may rely on the lists of Group Review Receivables provided by the Servicer; (iii) obtain or confirm the validity of the Review Materials and may rely on the accuracy and completeness of the Review Materials and will have no liability for any errors in the Review Materials; (iv) obtain missing or insufficient Review Materials from any party or any other source (other than its obligation to notify the Servicer pursuant to Section 3.3(b)); (v) take any action or cause any other party to take any action under any of the Transaction Documents or any other Series Related Documents or otherwise to enforce any remedies against any Person for breaches of representations or warranties about the applicable Group Review Receivables; or (vi) establish cause, materiality or recourse for any Test Fail.
