Common use of Revocation of Certificates Clause in Contracts

Revocation of Certificates. The Subscriber agrees to the following obligations relating to revocation of certificates: (a) The Subscriber must immediately request that LDRC revoke a certificate if: (i) the password or private keys, or if applicable, the token, of the Subscriber have been, or if it is suspected they may have been, compromised, or are insecure in any way; (ii) any of the information contained in the certificate, or any of the identification and authentication information has been changed or altered, or is otherwise no longer accurate or complete; or (iii) the designated certificate holder is no longer authorized or designated to use the certificate for the purposes of electronic transactions authorized by LSM. (b) The Subscriber may request that LDRC revoke a certificate by signed notice at any time prior to the expiration of the certificate., LSM or others may revoke a certificate if a subscriber is a lawyer entitled to practice law in the Province of Manitoba but LSM terminates or suspends that entitlement. Where a request for revocation has been made, the Subscriber will cease to assume financial and legal responsibility for any electronic transactions using the Subscriber's certificate which are effected more than 48 hours after the time of the notice. (c) The Subscriber acknowledges that LDRC or LSM may revoke a certificate if: (i) any of the information in the certificate changes; (ii) LDRC or LSM knows, or has reason to suspect, that the private keys of the Subscriber have been compromised; (iii) LDRC or LSM knows, or suspects that, the Subscriber’s password or, if applicable, the Subscriber's token, has been compromised; (iv) the certificate of the LDRC certification authority, which was used to sign a certificate, is revoked; (v) the Subscriber fails to comply with his or her obligations under this agreement, including the obligation to pay fees incurred as a result of use of the certificate; or (vi) LSM or LDRC deem the revocation to be necessary for any reason. (d) LDRC will provide notice of any revocation. This will be published in the certificate revocation list within 24 hours of a request under paragraph (b) or a revocation under paragraph (c). A revocation does not affect the authenticity of a message digitally signed before the revocation, or the Subscriber's responsibility for it; (e) If LDRC revokes a certificate, the Subscriber may request a new certificate, but is under no obligation to issue one.

Revocation of Certificates. The Subscriber agrees ‌ Certificates that have been revoked may no longer be actively used and shall without excep- tion be published as invalid in so-called revoca- tion lists ("CRL") and the online revocation ser- vice ("OCSP"). Where appropriate, SWISSSIGN may at any time declare the certificate of a SUBSCRIBER or CER- TIFICATE HOLDER to be invalid with immediate effect and without prior notice on grounds in- cluding the following obligations relating to revocation within a maximum of certificates24 hours after the occurrence of the event was dis- covered: (a) The Subscriber must immediately request that LDRC revoke CERTIFICATE HOLDER or SUBSCRIBER requests SWISSSIGN in writing to declare its certificate invalid, b) The SUBSCRIBER or CERTIFICATE HOLDER commits a certificate if: (i) the password or private keys, or if applicable, the token, breach of the Subscriber have beenagreed terms and/or applicable laws, regulations and ordinances. c) The SUBSCRIBER or if it CERTIFICATE HOLDER informs SWISSSIGN that the original certifi- cate request was unauthorised and not ap- proved or that the approval has been with- drawn. d) SWISSSIGN obtains information suggesting that the private key of the SUBSCRIBER or CERTIFICATE HOLDER, which corresponds to the public key of the certificate, has been potentially compromised or that the certifi- cate has been otherwise potentially misused. e) SWISSSIGN becomes aware of the fact that the SUBSCRIBER or CERTIFICATE HOLDER has committed a breach of one or more mate- rial obligations under this SUBSCRIBER AGREEMENT. f) SWISSSIGN becomes aware of circumstanc- es that suggest that the usage of a fully quali- fied domain name or an IP address for the certificate is suspected they may have beenno longer legally permitted (e.g. a court of law or arbitral tribunal has revoked the right of a party registering a domain name to use the domain name, compromised, a relevant licence or are insecure service contract between the party register- ing a domain name and the applicant for the certificate has been terminated or the regis- tration authority for a domain name has failed to renew the domain name). g) SWISSSIGN becomes aware of the fact that a wild card certificate has been used in any way;order fraudulently to authenticate misleading sub- ordinate fully qualified domain names. (iih) any SWISSSIGN becomes aware of a change in the information contained in the certificate, or any . i) SWISSSIGN becomes aware of the identification and authentication information has been changed fact that the certificate was not issued in accordance with the CA/Browser Forum Baseline Re- quirements or altered, the applicable CP/CPS of SWISSSIGN or is otherwise can no longer accurate or complete; or (iii) be valid on the designated certificate holder is no longer authorized or designated to use the certificate for the purposes basis of electronic transactions authorized by LSMnew regulations. (iik) LDRC SWISSSIGN discontinues operations for any reason and has not made provision for anoth- er certification authority to provide support for declaring the certificate invalid. l) The right of SWISSSIGN to issue certificates that are compliant with the CA/Browser Fo- rum Baseline Requirements has expired or LSM knows, is revoked or terminated and SWISSSIGN has reason not made provision to suspect, maintain the CRL/OCSP directories that are relevant for revocation. m) SWISSSIGN becomes aware that a private key of a SubCA or Managed PKI was used in order to issue the private keys of the Subscriber certificate may have been compromised;. n) The technical content or format of the certifi- cate represents an unacceptable risk for the providers of application software or third par- ties (iiie.g. the CA/Browser Forum is able to es- tablish that an obsolete cryptography/key al- gorithm or an obsolete key size represents an unacceptable risk and that such certificates should be declared invalid and replaced by certification authorities within a particular pe- riod of time). o) LDRC or LSM knows, or suspects that, A private key of the Subscriber’s password or, if applicable, SWISSSIGN certification authority within the Subscriber's token, chain of trust of the cer- tificate has been compromised; (iv) . Reference is made to the CP/CPS for any further reasons for a declaration of invalidity. SWISSSIGN shall in addition be entitled to inves- tigate all incidents and, where required, to take action as provided for by law. The certificate in question shall become invalid after the declaration of invalidity. The CERTIFI- XXXX XXXXXX shall bear liability for all losses arising in relation to the LDRC certification authority, which was used to sign usage of a certificate, is revoked; (v) the Subscriber fails to comply with his or her obligations under this agreement, including the obligation to pay fees incurred certificate that has been declared invalid. SWISSSIGN does not accept any liability for losses of any kind whatso- ever arising as a result of use of the certificate; or (vi) LSM or LDRC deem the revocation such usage. The SUB- XXXXXXX shall have no entitlement to be necessary for any reason. (d) LDRC will provide notice of any revocation. This will be published in the certificate revocation list within 24 hours a free re- placement of a request under paragraph (b) or a revocation under paragraph (c)certificate that has been declared invalid.
