Common use of Right of Action Clause in Contracts

Right of Action. All rights of action in respect of the Warrants are vested in the respective registered holders of the Warrants and any registered holder of any Warrant, without the consent of the holder of any other Warrant, may, in its own behalf and for its own benefit, enforce, and may institute and maintain any suit, action or proceeding against the Company to enforce, or otherwise act in respect of, its right to exercise the Warrants held by it in the manner provided therein.

Right of Action. Right of Action. All rights Rights of action in respect of the Warrants Warrant Agreement are vested in the respective any registered holders of the Warrants Warrantholder, and any registered holder Warrantholder, including Royal Bank, or any group of any Warrantregistered Warrantholders, without the consent of the holder of any other Warrantincluding Royal Bank, may, in its own behalf and for its own benefit, may enforce, and may institute and maintain any suit, action or proceeding against the Company eSpeed to enforce, or otherwise act in respect of, its right to exercise the Warrants held by it in the manner provided thereinsuch rights of such Warrantholders.

All rights of action in with respect of the Warrants to this Agreement are vested in the respective registered holders Holders of the Warrants Warrants, and any registered holder Holder of any Warrant, without the consent of the holder Warrant Agent or the Holders of any other Warrant, may, in its his own behalf and for its his own benefit, enforce, and may institute and maintain any suit, action or proceeding against the Company Newco suitable to enforce, or otherwise act in respect of, its his right to exercise the his Warrants held by it in the manner provided thereinin the Warrant Certificate representing his Warrants and in this Agreement.
