Common use of RIGHT OF DISPOSAL OF SOFTWARE, DOCUMENTATION, ETC Clause in Contracts

RIGHT OF DISPOSAL OF SOFTWARE, DOCUMENTATION, ETC. The Customer is granted a right of disposal in respect of software in accordance with the concluded agreement governing rights of disposal. If maintenance is performed by software being replaced, the Customer is granted the same rights in respect of the new software as it had in respect of the software being replaced. The Customer is granted a right of disposal in respect of any documentation and reports that the Customer receives pursuant to the concluded agreement governing rights of disposal. If no such agreement exists, the Customer is granted the right of disposal necessary to utilise the documentation for its activities and for the cooperation necessary with the Customer's contractual partners. When documentation and reports are updated, the Customer is granted the same rights in respect of the updated documentation or reports as it had in respect of the originals.
