Common use of Right of suspension – Access Holder Clause in Contracts

Right of suspension – Access Holder. (a) Queensland Rail (acting reasonably) may, by notice in writing to the Access Holder, immediately suspend the right of the Access Holder to have an Operator operate some or all of the Train Services upon the occurrence of any one or more of the following events or circumstances: (i) any event or circumstance described in clauses 15.2(a) to (f) occurs which has not been remedied in accordance with clause 15.5. (b) Such a suspension will continue until such time as the Access Holder has satisfied Queensland Rail (acting reasonably) that: (i) the relevant event or circumstance has been remedied or, if applicable, has been avoided and will not re-occur; and where appropriate, that the Access Holder has taken action to prevent the recurrence of that event or circumstance.
