Right to File Patent Applications. The Recipient is free to file patent application(s) claiming inventions made by, or on behalf of, the Recipient through the use of the Material but agrees not to file any patent application containing a composition of matter claim for the Material, per se.

Right to File Patent Applications. (a) Each Party has the right, but is not obligated, in respect of its own inventions to file patent applications (including utility models) covering the manufacture, use or sale of Products in its own name and at its own expense in any country.
