Right to Immediate Payment or Performance. The Trustee or Trustees shall not be bound to make any demand on or to seek or exhaust their recourse against the Issuers or any other Person before being entitled to demand payment from the Guarantors or any one of them and enforce their rights under this Agreement, and each Guarantor hereby renounces all benefits of discussion and division.
Right to Immediate Payment or Performance. 5.2.1 Tarion shall not be bound to make any demand on or to seek or exhaust its recourse against the Builder or any other person or to realize on any Security or assurances held by Tarion in respect of the Indemnified Amounts before being entitled to demand payment from or performance by the Builder and enforce its rights under this Agreement and the Builder hereby renounces all benefits of discussion and division.

Neither the Agent nor any Penn West Lender shall be bound to make any demand on or to seek or exhaust its recourse against any Other Penn West Party or any other Person or any Security Interest, if any, held by it, before being entitled to demand payment from or performance by the Guarantor and enforce its rights under this Agreement, and the Guarantor hereby renounces all benefits of discussion and division.

The Administrative Agent or Hedge Provider, as applicable, shall not be bound to make any demand on or to seek or exhaust its recourse against the Borrower or any other Person or any Security Interest held by it or any Lender or any Hedge Provider, before being entitled to demand payment from or performance by the Guarantor and enforce its rights under this Agreement, and the Guarantor hereby renounces all benefits of discussion and division.

The Seller shall not be bound to make any demand on or to seek or exhaust its recourse against the Purchaser or any other Person in respect of the Guaranteed Obligations before being entitled to demand payment from or performance by the Guarantor and enforce its rights under this Agreement and the Guarantor hereby renounces all benefits of discussion and division, provided that the Seller shall not make demand upon the Guarantor except in accordance with the terms of this Agreement.
