Right to Modify Orders. Prior to delivery, Supplier reserves the right to make substitutions, modifications and improvements to the Equipment and Software, provided that such substitution, modification or improvement shall not diminish or materially affect the performance of the Software applications as they were originally demonstrated to and agreed upon by Customer and Supplier.
