Right to Proceed. Anything in this Agreement to the contrary notwithstanding, if any of the conditions specified in Section 8 hereof have not been satisfied, Buyer shall have the right to proceed with the transactions contemplated hereby without waiving any of its rights hereunder, and if any of the conditions specified in Section 9 hereof have not been satisfied, the Partners shall have the right to proceed with the transactions contemplated hereby without waiving any of their rights hereunder.
