Common use of Right to Reemployment Clause in Contracts

Right to Reemployment. A. Right to Reemployment to Vacancy after Reduction in Force Each person who has been laid off or demoted in-lieu-of a layoff from a position the person held shall, in writing, be offered reappointment in the same classification in the same department should a vacancy occur in the classification within two (2) years after the layoff or demotion. B. Right to Reemployment to Contingent Hire (Extra Hire) Position after Reduction in Force If a Contingent Hire (Extra Hire) position is opened in the same department and classification in which a Regular Hire employee who held status has been laid off or demoted in-lieu-of layoff, in order of seniority in the classification, the Regular Hire employee who held status shall be offered the Contingent Hire (Extra Hire) position, based upon the existing reemployment list. Within one (1) year after the layoff or demotion, this Regular Hire employee shall be offered this Contingent Hire (Extra Hire) position in writing should a Contingent Hire (Extra Hire) vacancy occur in the same classification and department in which the employee held status.
