Common use of Right to Refuse to Work Clause in Contracts

Right to Refuse to Work. Subject to all provisions of the Northwest Territories Safety Act R.S.N.W.T. 1988 c.s-1, as amended and to the Safety Regulations prescribed under the Safety Act as amended: (a) employees may refuse to do any work where they have reason to believe that: (i) there exists an unusual danger to their health and safety; (ii) the carrying out of the work is likely to cause to exist an unusual danger to their health or safety or that of any other person; or (iii) the operation of any tool, appliance, machine, device or thing is likely to cause to exist an unusual danger to their health or safety or that of any other person. (b) ‘unusual danger’ means, in relation to any condition: (i) a danger that does not normally exist in that occupation; or (ii) a danger under which persons engaged in that occupation would not normally carry out their work. (c) No loss of wages or discriminatory action shall be taken against employees by reason of the fact that they exercised the right conferred upon them in subsection (a). (d) No other employee shall be required to use or operate any machine, device, material or thing or perform any part of the work which is being investigated pending resolution of the situation.
