Common use of Right to Repay Redemption Price in Trust Units Clause in Contracts

Right to Repay Redemption Price in Trust Units. (a) Subject to the other provisions of this Section 4.6, the REIT may, at its option, elect to satisfy its obligation to pay the Redemption Price, in whole or in part, by issuing and delivering to holders on the Redemption Date that number of Freely Tradeable Trust Units obtained by dividing the aggregate principal amount of Debentures being redeemed by 95% of the Current Market Price of the Trust Units on the Redemption Date (the “Unit Redemption Right”).
