Common use of Right to Return to Previous Job Clause in Contracts

Right to Return to Previous Job. When a non-probationary EMPLOYEE has been promoted or reassigned to another position in the unit and when the EMPLOYEE's new job title is subject to a RIF, upon request, the EMPLOYEE shall be placed in his/her prior immediate job title for the purpose of implementing this Section. Said EMPLOYEE must make the request in writing to the Superintendent within ten (10) calendar days of notification that the EMPLOYEE's position is subject to RIF. The notification date shall be the date of postmark of the notification to the EMPLOYEE. The date of request shall be the date of postmark of the request to the district.
