As such, it is the intent of the parties that students with disabilities are provided the same degree of dignity and respect that is afforded to all students. Least Restrictive Environment This principle establishes that, to the maximum extent appropriate, each student with a disability is educated with children who are not disabled. The principle further affirms that special classes, separate schooling or other removal of children with disabilities from the regular educational environment occurs only when the nature and severity of the disability are such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily.

Right to Service. Xxxxx shall have the right to service or have serviced the Product at its discretion in alignment with the service regulations of AVIA Ashok. AVIA Ashok agrees to provide to Xxxxx all relevant technical data and service related materials for the Products, which are usually provided to customers and dealers. AREAS OF INTENT TO COOPERATE Responsibilities and Coordination of Services Procedures Each agency will identify personnel at the state level responsible for liaison with the other agency. Designated personnel will recommend operational procedures and priorities defining services, and scope. Liaison staff will resolve problems or issues in accordance with the dispute resolution process outlined in this agreement. The liaison staff will recommend necessary policy clarification and procedures to carry out the terms of this agreement. DOE will assume the responsibility for notifying LEAs of the content of this agreement, as well as assist and provide consultation to LEAs in developing needed procedures or mechanisms to carry out the terms of this agreement. DSS agrees to assist LEAs in enrolling as South Dakota Medicaid providers. DOE will be responsible for the state or local funds required to match the federal Medicaid funds. Right to Service a. We reserve the right to refuse to provide Services to anyone for any reason. If you provide inaccurate or false registration information, do not immediately notify iiRide of changes to your registration information or if you fail to comply with applicable laws or this Service Agreement, We may refuse service or terminate your account(s) without prior notice to you. To be able to transact payments out of the iiRide Service, you will need to undertake a 100- point identification check by providing documents as follows: Individuals and companies are to provide any two of the following clear pictures from within the app: • Australian driver licence • Medicare card • Australian passport • Australian working visa • Birth Certificate Companies must provide in-app: • ABN/ACN and • Full Company name iiRide will verify information provided and advise you by email.
Right to Service. The Representative shall, at its sole cost and subject to clause 4.2 responsibility, provide services related to all Relevant Gaming Machines and Relevant Table Gaming Products sold by it in the Exclusive Territory (which such services include but are not limited to maintenance services, training services, installation services and customisation services), and shall be solely entitled to any service fees received from such customers.

  • Right to Set-Off If your Account balance becomes and remains negative, we can use the funds in any of your accounts with us to repay the negative balance in your Account without any further notice to or demand on you. Moreover, we have the right to set-off any liability, direct or contingent, past, present or future that you owe against any account you have with us. Further, you grant us a lien on and security interest in the funds on deposit in each of your account(s) as security for all of your liabilities and obligations to us, now or in the future.

  • The Service Provider (a) shall take out and maintain, and shall cause any Subcontractors to take out and maintain, at its (or the Sub contractors', as the case may be)own cost but on terms and conditions approved by the Procuring Entity, insurance against the risks, and for the coverage, as shall be specified in the SCC; and

  • Right to Sell Assignor may not Transfer any interest in the Xxxxx, the Subject Interests or any part thereof or any undivided interest therein in violation of Section 11.03. Subject to Section 11.02 and 11.03, Assignor may from time to time Transfer, mortgage or pledge its interest in the Xxxxx, the Subject Interests, or any part thereof or undivided interest therein, if and only if (i) such Transfer, mortgage or pledge is made expressly subject to and burdened with the Royalty Interest and this Conveyance; (ii) solely in connection with a Transfer other than a Transfer pursuant to a foreclosure on any mortgage or security interest, Assignor has caused the assignee, purchaser, transferee or grantee of any such transaction to (A) acknowledge that the affected Subject Interests are taken subject to and burdened with the Royalty Interest and this Conveyance, and (B) assume and agree to discharge Assignor’s obligations under this Conveyance with respect to such Subject Interests from and after the actual date of any such Transfer; and (iii) in connection with any Transfer pursuant to a foreclosure on any mortgage or security interest, Assignor has used commercially reasonable efforts to cause the assignee, purchaser, transferee or grantee of any such transaction to (A) acknowledge that the affected Subject Interests are taken subject to and burdened with the Royalty Interest and this Conveyance, and (B) assume and agree to discharge Assignor’s obligations under this Conveyance with respect to such Subject Interests from and after the actual date of any such Transfer. Any assumption and agreement to discharge shall be by appropriate written instrument for the express benefit of and enforceable by Assignee. For the avoidance of doubt, nothing in this Section 11.01(a) is intended to permit any assignee, purchaser, transferee or grantee to acquire any interest in the Xxxxx, the Subject Interests or any part thereof or undivided interest therein without being subject to and burdened with the Royalty Interest and this Conveyance. Assignee shall not be required to recognize any purported Transfer, mortgage or pledge not made in conformance with this Section 11.01(a) and, notwithstanding any such purported Transfer, mortgage or pledge, Assignor shall remain obligated under this Conveyance just as if such Transfer, mortgage or pledge attempt had not been made and Assignee shall continue to deal with Assignor to the exclusion of the purported transferee. Further, to the extent permitted by applicable Legal Requirements, any purported Transfer not made in conformance with this Section 11.01(a) shall be void and of no effect.
