Common use of Rights as Lender Clause in Contracts

Rights as Lender. With respect to its Revolving Commitments and the Advances made by it, Xxxxx Fargo (and any successor acting as Administrative Agent) in its capacity as a Lender hereunder shall have the same rights and powers hereunder as any other Lender and may exercise the same as though it were not acting as the Administrative Agent, and the term “Lender” or “Lenders” shall, unless the context otherwise indicates, include the Administrative Agent in its individual capacity. Xxxxx Fargo (and any successor acting as Administrative Agent) and its Affiliates may (without having to account therefor to any Lender) accept deposits from, lend money to, make investments in, provide services to, and generally engage in any kind of lending, trust, or other business with any Credit Party or any of its Subsidiaries or Affiliates as if it were not acting as Administrative Agent, and Xxxxx Fargo (and any successor acting as Administrative Agent) and its Affiliates may accept fees and other consideration from any Credit Party or any of its Subsidiaries or Affiliates for services in connection with this Agreement or otherwise without having to account for the same to the Lenders.

Xxxxx Fargo Bank of America (and any successor acting as the Administrative Agent) and its Affiliates may (without having to account therefor to any Lender) accept deposits from, lend money to, make investments in, provide services to, and generally engage in any kind of lending, trust, or other business with any Credit Loan Party or any of its Subsidiaries or their respective Affiliates as if it were not acting as the Administrative Agent, and Xxxxx Fargo Bank of America (and any successor acting as the Administrative Agent) and its Affiliates may accept fees and other consideration from any Credit Loan Party or any of its Subsidiaries or their respective Affiliates for services in connection with this Agreement or otherwise without having to account for the same to the Lenders.

Xxxxx Fargo NationsBank (and any successor acting as Administrative Agent) and its Affiliates affiliates may (without having to account therefor to any Lender) accept deposits from, lend money to, make investments in, provide services to, and generally engage in any kind of lending, trust, or other business with any Credit Party Covered Person or any of its such Covered Person's Subsidiaries or Affiliates as if it were not acting as Administrative Agent, and Xxxxx Fargo NationsBank (and any successor acting as Administrative Agent) and its Affiliates may accept fees and other consideration from any Credit Party Covered Person or any of its Subsidiaries or Affiliates for services in connection with this Agreement or otherwise without having to account for the same to the Lenders.

With respect to its Revolving Commitments Pro Rata Share of the Aggregate Loan Commitment and the Advances Loans made by it, Xxxxx Fargo DFS (and any successor acting as Administrative Agent) in its capacity as a Lender hereunder shall have the same rights and powers hereunder as any other Lender and may exercise the same as though it were not acting as the Administrative Agent, and the term “"Lender” " or “"Lenders” " shall, unless the context otherwise indicates, include the Administrative Agent in its individual capacity. Xxxxx Fargo DFS (and any successor acting as Administrative Agent) and its Affiliates may (without having to account therefor to any Lender) accept deposits from, lend money to, make investments in, provide services to, and generally engage in any kind of lending, trust, or other business with any Credit Party party or any of its Subsidiaries or Affiliates as if it were not acting as Administrative Agent, and Xxxxx Fargo DFS (and any successor acting as Administrative Agent) and its Affiliates may accept fees and other consideration from any Credit Party Person or any of its Subsidiaries or Affiliates for services in connection with this Agreement or otherwise without having to account for the same to the Lenders.

Xxxxx Wxxxx Fargo (and any successor acting as Administrative Agent) and its Affiliates may (without having to account therefor to any LenderSecured Party) accept deposits from, lend money to, make investments in, provide services to, and generally engage in any kind of lending, trust, or other business with any Credit Party or any of its Subsidiaries or Affiliates as if it were not acting as Administrative Agent, and Xxxxx Wxxxx Fargo (and any successor acting as Administrative Agent) and its Affiliates may accept fees and other consideration from any Credit Party or any of its Subsidiaries or Affiliates for services in connection with this Agreement or otherwise without having to account for the same to the LendersSecured Parties.

Xxxxx Fargo Whitebox Advisors LLC (and any successor acting as Administrative Agent) and its Affiliates may (without having to account therefor to any LenderXxxxxx) accept deposits from, lend money to, make investments in, provide services to, and generally engage in any kind of lending, trust, or other business with any Credit Party or any of its Subsidiaries or Affiliates as if it were not acting as Administrative Agent, and Xxxxx Fargo Whitebox Advisors LLC (and any successor acting as Administrative Agent) and its Affiliates may accept fees and other consideration from any Credit Party or any of its Subsidiaries or Affiliates for services in connection with this Agreement or otherwise without having to account for the same to the Lenders.
