Rights of Publix. Anything to the contrary contained herein notwithstanding, for so long as the Publix Lease remains in place or Publix, its subsidiary or affiliate, purchases all or any portion of the Property, (i) this Declaration may be abrogated, modified, rescinded or amended in whole or in part only with the consent of Publix; (ii) Publix shall have the right, but not the obligation, to enforce this Declaration, and to avail itself of the remedies provided herein or otherwise at law or in equity for violation hereof, to the same extent as the Shopping Center Owner, (iii) Publix shall have the right, but not the obligation, to cure a breach or default hereunder by the Shopping Center Owner, which enforcement shall be accepted by the other Owner(s) as if effected by the Shopping Center Owner. The rights of Publix pursuant to this Declaration are intended to be in addition to the rights of Publix under the Publix Lease, and nothing in this Declaration shall be construed as reducing, diminishing, replacing or any way modifying the rights of Publix under the Publix Lease. Notwithstanding any provisions of this Declaration to the contrary, to the extent of any inconsistency or conflict between this Declaration and the Publix Lease, the Publix Lease shall control and govern. Additionally, any terms or provisions of this Declaration that state that they are only effective so long as the Publix Lease has not expired or terminated, or state that they expire upon expiration or termination of the Publix Lease, shall remain in full force and effect if the expiration or earlier termination of the Publix Lease is due to Publix acquiring fee title to the portion of the Shopping Center Tract where the Publix Storeroom is located.

Any changes or modifications to the process and procedures required by Specification 7 following the Effective Date must be approved in advance by ICANN in writing. Registry Operator must comply with all remedies imposed by ICANN pursuant to Section 2 of Specification 7, subject to Registry Operator’s right to challenge such remedies as set forth in the applicable procedure described therein. Registry Operator shall take reasonable steps to investigate and respond to any reports from law enforcement and governmental and quasi-­‐governmental agencies of illegal conduct in connection with the use of the TLD. In responding to such reports, Registry Operator will not be required to take any action in contravention of applicable law.

  • Rights of Survivorship Unless otherwise stated on the Account Card or documented through the Credit Union’s online application and authentication process, a joint account includes rights of survivorship. This means that when one (1) owner dies, all sums in the account will pass to the surviving owner(s). For a joint account without rights of survivorship, the deceased owner’s interest passes to his or her estate. A surviving owner’s interest is subject to the Credit Union’s statutory lien for the deceased owner’s obligations and to any security interest or pledge granted by a deceased owner, even if a surviving owner did not consent to it.
