Roads and Utilities. Owner shall provide and maintain the ditches and permanent roads, including the gravel, pavement or concrete, with the roads passing standard compaction tests. (Design-Builder will maintain aggregate construction roads during construction of the Plant and will return to original pre-construction condition prior to Owner completing final grade and surfacing.) Except as otherwise specifically stated herein the Owner shall install all utilities so that they are within five (5) feet of the designated building/structure locations.

Roads and Utilities. All utility and sanitary sewage services necessary for the construction and use of the Projects are or will be available to the Properties upon which the Improvements are to be constructed prior to commencement of construction, or the necessary rights-of-way or easements therefor have been or will be acquired or dedicated, and all necessary steps have been or will be taken to insure the completion thereof prior to the date of termination of the Lenders’ obligations to make Advances on each applicable Project, and the Borrower has or will receive permission to make such use thereof as is necessary for construction and to make permanent connections thereto upon completion of such Improvements.
