Roads and Utilities. All utility, water and sanitary sewage services necessary for the construction and use of the Improvements are available to the Property and BCOI and Developer have received permission to make such use thereof as is necessary for construction of the Improvements and as is necessary for the use thereof after completion of the Improvements. The Property abuts upon or has access via one or more valid and subsisting easements or rights or way, to a physically open and publicly dedicated street.
