Sanitary Sewer Improvements. The City and Parcel Owners agree that the following sanitary sewer improvements, which are shown on Exhibit “F”, are necessary to serve the annexation of all of the Property and to promote the general health and welfare of the City.

Sanitary Sewer Improvements. District shall plan, construct, and complete a sanitary sewer line on the Property as depicted in the attached “Exhibit C”, which is incorporated by this reference into this Agreement, (“Sanitary Sewer Improvements”). The Sanitary Sewer Improvements shall be connected on the south end to the City’s main sanitary sewer line. Upon completion of construction, inspection by City, and approval by City, City shall assume ownership of the Sanitary Sewer Improvements and all appurtenances thereto. Construction of the Sanitary Sewer Improvements, connection to the City’s main sanitary sewer line, and transfer of ownership to City shall be completed no later than [date] (“Construction Period”). Nothing contained herein shall be construed to restrict District’s right to construct the Sanitary Sewer Improvements at any time prior to the expiration of the Construction Period or to continue constructing the Sanitary Sewer Improvements after the Construction Period, so long as District is making substantial and continuing progress toward completion of the Sanitary Sewer Improvements. Further, the Construction Period shall be extended as necessary to accommodate delayed progress of the Sanitary Sewer Improvements due to changes in work, any act or omissions of Owner or its employees, agents, or representatives that are contrary to this Agreement or any other cause that is not reasonably foreseen or beyond the control of District, its subcontractors, or suppliers including, but not limited to acts of God, acts of a government authority, natural or manmade disaster, delay in the transportation or shortages of materials or equipment, abnormal weather conditions or labor disputes.
Sanitary Sewer Improvements. 5.1. The District shall make a one-time payment of Eight Hundred Eighty Thousand Dollars and NO/100 ($880,000.00) to Unified Government Water Pollution Control as a sewer connection fee within ten (10) days of the Effective Date of this Agreement
5.2. The District shall grant sanitary sewer easements to the Unified Government in accordance with Unified Government standards and criteria upon the establishment of the final public sanitary sewer alignment.
Sanitary Sewer Improvements. A 10 inch sanitary sewer line to serve the NS Parcel will be constructed/installed by the City from the existing City sanitary sewer line along Xxxxxxx Road, north along the east side of Xxxxxxx Court to the NS Parcel (the “Sanitary Sewer Improvements”). In the event the funds received under/from the CDAP grant exceed the aggregate costs of the Sanitary Sewer Improvements and the Water Improvements, the City may construct/install with such excess funds additional sanitary sewer improvements, at its sole cost and expense, including a new lift station and force main on Xxxxx Road. Neither NS nor ProLogis shall have any obligation to construct/install such additional, sanitary sewer improvements or pay for same. All costs of the Sanitary Sewer Improvements in excess of the funds received from/under the CDAP grant shall first be paid 75% by NS, and 25% by ProLogis; provided, however, that such ProLogis payment shall not exceed $25,853.00. NS shall pay any costs of the Sanitary Sewer Improvements in excess of the funds received under/from the CDAP grant and the aforedescribed payments by NS and ProLogis. In no event shall the City be required to pay for any of the Sanitary Sewer Improvements which are not paid for by the CDAP Grant. Upon receipt of an invoice for Sanitary Sewer Improvements not covered by the CDAP Grant, the City will xxxx the costs included in the invoice to ProLogis and NS in the appropriate percentage owed by each, and such xxxx from the City will be payable within 10 days of receipt. Anything contained in this Agreement to the contrary notwithstanding, in the event that the ProLogis SSI Payment Cap is met/reached, or exceeded, and either the “ProLogis RI Payment Cap” (as defined in this Section 4), or the “ProLogis WI Payment Cap” (as defined in this Section 4) is, or both the ProLogis RI Payment Cap and the ProLogis WI Payment Cap are, not met/reached, or exceeded, at, and to the extent of, the request of NS, the ProLogis SSI Payment Cap shall be increased by an amount or aggregate amounts up to: the amount, if any, by which the ProLogis RI Payment Cap exceeds the payment obligation of ProLogis under Subsection 4(a) and/or, the amount, if any, by which the ProLogis WI Payment Cap exceeds the payment obligation of ProLogis under Subsection 4(b). Any increase of the ProLogis SSI Payment Cap as aforedescribed shall reduce the ProLogis RI Payment Cap and/or the ProLogis WI Payment Cap in the aggregate amount of such increase. Sanitary Sewer Improvements. Sanitary sewer service shall be provided to each building and to the community building by the Sub-Divider. A sanitary sewer line shall extend to the exterior perimeter property line of the development to provide service to adjacent properties.
Sanitary Sewer Improvements. The Sanitary Sewer Improvements project includes the construction of approximately 630 lineal feet of sanitary sewer main, six (6) manholes, with all necessary appurtenances, to serve the Real Estate with public sanitary sewer service from the City of Manhattan.
Sanitary Sewer Improvements. The Town does not provide sanitary sewer service to the Property. The Town does not warrant the availability of sewer service from the St. Vrain Sanitation District (“SVSD”) system for any Phase. Unless the Town has agreed to alternative provider of sanitary sewer service, in the Town’s sole and absolute discretion (in which case Developer will reimburse the Town for its pro rata share of costs and expenses incurred in connection with any required 208 boundary adjustment), Developer shall be responsible to install, at Developer’s sole cost and expense, all the sewer mains, trunk lines, pumping facilities and appurtenances necessary to provide service from the existing SVSD system to the Property in connection with each Phase, including both on-site and off-site improvements, pursuant to SVSD requirements, approved plans, and specifications and to pay all sewer connection and plant investment fees as set by SVSD from time to time, with respect to each Phase; provided, however, that to the extent the Property is subject to a separate agreement with SVSD for provision of such improvements, such agreement will control over any conflicting or inconsistent provision of this Agreement. The Town may condition issuance of building permits for any Phase upon proof of purchase of a sewer tap for each building site within such Phase.
