Role/Expectations of NDDOT. ‌ NDDOT is empowered through assumption of responsibilities as provided under Federal law to monitor, review, and/or approve activities related to the use of Federal- aid funds. NDDOT, in conformance with Title 23, U.S.C., accepts responsibilities for assumed duties in this Agreement. NDDOT is responsible for administering the assumed aspects of the Federal-aid Highway Program in a manner that ensures efficient and effective use of the Federal-aid funds and compliance with federal laws and regulations. NDDOT, along with FHWA, is responsible for ensuring financial integrity and compliance with applicable laws and regulations. NDDOT shall comply with applicable laws and regulations regardless of funding source in order to maintain Federal-aid eligibility.

  • Conditions of Eft Services (a.) Ownership of Card(s). IT IS THE INTENT OF THE PARTIES THAT THE LIMITATIONS IMPOSED IN THIS ARTICLE SEVEN ON REMEDIES AND THE MEASURE OF DAMAGES BE WITHOUT REGARD TO THE CAUSE OR CAUSES RELATED THERETO, INCLUDING THE NEGLIGENCE OF ANY PARTY, WHETHER SUCH NEGLIGENCE BE SOLE, JOINT OR CONCURRENT, OR ACTIVE OR PASSIVE. The Customer may participate in such defense and in any settlement discussions directly or through counsel of the Cus tomer’s choice, at the Customer’s expense, provided such participation does not materially prejudice Axway’s sole control of the defense or cause Axway to incur material additional costs in the conduct of such defense .
