Common use of RPRP Exclusive Clause in Contracts

In the event that Introgen does not elect to enter into a Joint Venture for marketing of a Collaboration Product in North America in accordance with 7.3.1 above, or subsequently elects not to proceed with such Joint Venture, RPRP shall have the exclusive right to market, sell and distribute such Collaboration Product in North America, subject to the payment of the amounts set forth in Section 8.1 and Article 9.
