Common use of RSU DEFERRAL ELECTION Clause in Contracts

RSU DEFERRAL ELECTION. The following constitutes an election by the undersigned director or officer of La Jolla Pharmaceutical Company to defer payment of vested benefits pursuant to the Restricted Stock Unit award referred to above granted to the undersigned on April 10, 2012 subject to the terms of the La Jolla Pharmaceutical Company 2010 Equity Incentive Plan (“Plan”).

RSU DEFERRAL ELECTION. The following constitutes an election by the undersigned director or officer of La Jolla Pharmaceutical Company to defer payment of vested benefits pursuant to the Restricted Stock Unit award referred to above granted to the undersigned on April 10August 17, 2012 subject to the terms of the La Jolla Pharmaceutical Company 2010 Equity Incentive Plan (“Plan”).

The following constitutes an election by the undersigned director or officer of La Jolla Pharmaceutical Company Avanir Pharmaceuticals to defer payment of vested benefits pursuant to the Restricted Stock Unit award referred to above granted to the undersigned on April 10, 2012 subject to under the terms of the La Jolla Pharmaceutical Company 2010 Avanir [2003] [2005] Equity Incentive Plan (“Plan”).

RSU DEFERRAL ELECTION. The following constitutes an election by the undersigned director or officer of La Jolla Pharmaceutical Company Avanir Pharmaceuticals, Inc. to defer payment of vested benefits pursuant to the Restricted Stock Unit award referred to above granted to the undersigned on April 10[___________], 2012 subject to 20___ under the terms of the La Jolla Pharmaceutical Company 2010 Avanir [2003] [2005] Equity Incentive Plan (“Plan”).
