CARB has initiated litigation challenging the SAFE Rule Part Two. BMW NA has moved to intervene in the litigation for the limited purpose of addressing the remedy if the court grants a petition for review of the SAFE Rule Part Two. Under CARB regulations, with the promulgation of SAFE Rule Part Two, compliance with the Federal Program is no longer deemed compliance with the CA Standards, and instead manufacturers are required to comply with the CA Standards without regard to the Federal Program beginning with the 2021 Model Year. 13 C.C.R. § 1961.3(c).
