Safeguarding and interpretation of the license. If any provision of the Licence is held to be illegal, invalid or unenforceable as determined by the Authority Having Jurisdiction, it shall be modified so as to be interpreted as enforceable and effective in a manner as close as possible to the original intent of the provision. The failure to enforce strict performance of any term of this License shall not be construed or interpreted as a waiver by JANBY of its right to enforce strict performance in the future. The declaration of invalidity of any one or more of the clauses set out in this Licence by the competent authority shall not prejudice the validity of the remaining clauses.
