SAFEGUARDING AND PROMOTING WELFARE. 10.1 In the event that a Regulated Activity is to be delivered by the Provider under the Agreement the Provider shall be a Regulated Activity Provider for the purposes of the SVGA with ultimate responsibility for the management and control of the Regulated Activity. 10.2 The Provider shall ensure that all Staff engaged in the provision of a Regulated Activity are: 10.2.1 subject to a valid enhanced disclosure check undertaken through the DBS; 10.2.2 subject to a check against the adults' barred list or the children's barred list, as appropriate; and 10.2.3 monitored to ensure the level and validity of the checks under this clause 10.2.
