Common use of Sale Not Contingent on Property Inspection Clause in Contracts

Sale Not Contingent on Property Inspection. If the Inspection Contingency box in Section 2.19 is “No”, then this Agreement is not subject to a property inspection contingency and Section 7.2 and its subsections do not apply. Buyer represents and warrants to Seller that: (a) Prior to execution of this Agreement, Xxxxx has had sufficient time and access to the Propert y to examine the condition of the Property and its boundaries and surrounding area, the title of the Property, including all Permitted Exceptions, any Community Documents governing the Property pursuant to Section 13.3.3, the occupancy status of the Property and any other matter which may affect Buyer's decision to execute this Agreement, including but not limited to those matters listed in Section 13 (among which, include without limitation, the possible presence of lead-based paint, mold, Chinese/problem drywall or radon gas); and (b) Buyer has either conducted or caused to be conducted examinations of the Property as Buyer deems necessary, or waived the opportunity to conduct or cause to be conducted an y examinations of the Property. Buyer hereby waives the opportunity to conduct any additional examinations of the Property.
