Common use of Sales, Marketing and Advertising Clause in Contracts

Sales, Marketing and Advertising. Manager, in accordance with the Yearly Budget and on behalf of Owner and at Owner’s expense, shall or shall cause its affiliates to: (a) advertise and promote the business of the Hotel; (b) institute and supervise a sales and marketing program for the Hotel; (c) include the Hotel in Manager’s local, regional and worldwide promotional and advertising programs directed at the leisure, business and meetings markets, as Manager may deem advisable; (d) represent the Hotel through Manager’s worldwide sales offices; (e) include the Hotel in the Six Continents Hotels loyalty program, presently called “Priority Club”, including, without limitation, inclusion of the Hotel in promotional materials distributed to participants of such program; (f) coordinate the Hotel’s participation in travel programs marketed by airlines, travel agents and government tourist departments when Manager determines such participation to be advisable; and (g) cause the Hotel to participate in sales and promotional campaigns and activities involving complimentary rooms, food and beverages to bona fide travel agents, tourist officials and airline representatives where Manager has determined that such participation is in furtherance of the Hotel’s business and is customary in the travel industry or in the practices and policies of Manager. (h) The Hotel’s Pro rata cost of participation in all of the foregoing programs shall be paid by Manager as an Operating Cost.
