Salvage Services. The Company has no obligation whatsoever to ▇▇▇▇▇▇▇ or provide any salvage service to the Vessel should she spring a leak or otherwise need assistance in remaining afloat or in Seaworthy condition. It is agreed that the Company, in its sole election, may elect to ▇▇▇▇▇▇▇ or provide the Vessel with other salvage services. In the event the Company determines the Vessel is in need of dewatering or other salvage services and the Company elects to provide such services, Vessel Owner shall be obligated to pay all material/labor costs associated with the rendering of such services or $150 plus material costs for each hour such services are provided, whichever sum is greater, and Vessel Owner shall indemnify, protect and defend the Indemnified Parties from and against all actual or potential liability therefrom arising or relating.

Notwithstanding that it has no duty to do so, in the event the Marina personnel determine that a Vessel is in need of denaturing or other salvage services it is agreed that the ▇▇▇▇▇▇ ▇▇▇ engage the services of a salvor to ▇▇▇▇▇▇▇ the Vessel and provide such other services as are, in the salvor's sole opinion, prudent under the circumstances. In such event, it is agreed that the salvor's services shall be provided at the Owner's sole risk, and that he/she shall immediately upon demand reimburse the Marina or pay the salvor directly for all services it provided. Owner agrees that in the event a salvor provides services for the benefit of Owner's Vessel, the Owner shall indemnify, protect and defend the Marina and the salvor from and against all actual or potential liability therefrom arising or relating.

  • Special Services Should the Trust have occasion to request the Adviser to perform services not herein contemplated or to request the Adviser to arrange for the services of others, the Adviser will act for the Trust on behalf of the Fund upon request to the best of its ability, with compensation for the Adviser's services to be agreed upon with respect to each such occasion as it arises.

  • OUR SERVICES As insurance intermediaries we generally act as the agent of our client. We are subject to the law of agency, which imposes various duties on us. Where we act on behalf of the insurer and not you, we will notify you accordingly and in relation to claims we will advise you of this fact when you notify us of a claim. We will advise you separately as to which of these apply before we arrange your policy and where we have not undertaken a fair analysis of the market, we will provide you with a list of insurers considered. The Contractor will comply with the EOHHS Pharmacy Home Program and the Generics First Initiative, including the maintenance of the drug formulary in accordance with the direction of the EOHHS Pharmacy Committee.
