Common use of SAVINGS CLAUSES Clause in Contracts

SAVINGS CLAUSES. A. If any provision of this Agreement or the application thereof is held invalid, the invalidity shall not affect other provisions or applications of the Agreement which can be given effect without the invalid provisions or applications and to this end the provisions of this Agreement are declared to be severable. B. If any provision of this Agreement would, in the written opinion of the Company's independent accountants, prevent or substantially interfere with the Company's ability to receive pooling treatment in any business combination, the offending provision will be deemed severed from this Agreement and the other provisions of this Agreement shall not be affected.
