SBE Participation. The Contractor understands that it is the policy of the Airport Authority that Certified SBEs should have the maximum practical opportunity to participate in the performance of contracts at the Airport. Accordingly, during the Term of this Agreement, the Contractor commits and agrees to Certified SBE (defined below) participation of at least [ %] in the goods or services provided under this Agreement (the “Certified SBE Commitment”). The Contractor hereby agrees, for the Term of this Agreement, to either (i) meet the Certified SBE Commitment or (ii) demonstrate that it has made all reasonable efforts to meet the Certified SBE Commitment, including all necessary and reasonable steps the Contractor takes to achieve the Certified SBE Commitment. Certified SBE participation toward the Certified SBE Commitment shall be measured as the total value of any goods or services provided by Certified SBEs under this Agreement, inclusive of all amendments, modifications and change orders. The Certified SBE Commitment may be met by the Contractor’s status as a Certified SBE, by joint venture with one or more Certified SBEs, by subcontracting a portion of the Agreement to one or more Certified SBEs, by purchasing materials used in the performance of the Agreement from one or more Certified SBEs, or by any combination of the foregoing. The Contractor’s failure to meet the Certified SBE Commitment or to provide the Airport Authority with sufficient documentation of the Contractor’s reasonable efforts to meet the Certified SBE commitment shall be sufficient cause for the Airport Authority to terminate this Agreement. If the Contractor has not met the Certified SBE Commitment, the Airport Authority has sole and absolute discretion to determine whether the Contractor has made all reasonable efforts to meet the Certified SBE Commitment. The Contractor must use any such forms as are required and made available by the Airport Authority to demonstrate that the Contractor has either met the Certified SBE Commitment or made all reasonable efforts to meet the Certified SBE Commitment. SBE Participation. Consistent with the City’s procurement code, Small Business Enterprises (SBE) shall have the opportunity to participate in this project. CONTRACTOR is hereby informed that the CITY has established a goal of 15% participation of SBE. Contractor is obligated to demonstrate and document a good faith effort toward the attainment of the 15% SBE participation as a condition of this contract. The CONTRACTOR agrees to maintain all relevant records and information necessary to document compliance with the Ordinance, and agrees to allow the CITY to inspect such records and provide such records to the CITY upon request.
SBE Participation. TJPA will not provide bid discounts or bid preferences for SBE participation. For contracts with no SBE goal, TJPA strongly encourages the prime contractor to make good faith efforts to include SBEs to perform meaningful work in all aspects of the project. To count towards an SBE contract goal, a business must be certified on the date bids or proposals are received.
SBE Participation. SBE Firms are not to commence work until they are approved. The SBE, including those business types other than subcontractor (i.e. supplier, trucking, service provider), must be submitted for subcontractor approval after the contract is executed and approved before to SBEs actual performance of work.

The Developer agrees that35% of applicable development costs will be subcontracted to Small Business Enterprises, though if there are insufficient qualified SBE’s this can be satisfied with CBE’s. Small Business Enterprises (SBEs) are a sub-classification of CBEs, and are detailed in the attached. SBEs are generally defined as local businesses which have annualized gross receipts of a maximum level, depending on the industry.
SBE Participation. The District shall award five (5) bonus points to a firm's total score of the evaluation criteria/matrix when the Proposer is certified as a Small Business Enterprise (SBE), as defined by the Small Business Administration (SBA), or is utilizing one or more SBEs to perform the work required under the contract. Proposer shall provide SBE verification for their firm and any SBE sub participants to ensure that firms receiving bonus points are eligible.
