Common use of SBIR Data Rights Clause in Contracts

SBIR Data Rights. The Government’s license rights to use properly marked SBIR Data during the SBIR Protection Period. Upon expiration of the protection period for SBIR/STTR Data, the Government has a royalty-free license to use, and to authorize others to use on its behalf, these Data for Government Purposes. The Government receives Unlimited Rights in all Form, Fit, and Function Data, Operations, Maintenance, Installation and Training (OMIT) Data, and unmarked SBIR Data. SBIR Protection Period: The period of time during which the Government is obligated to protect SBIR Data against unauthorized use and disclosure. The SBIR Protection Period begins at award of an SBIR Funding Agreement and ends not less than twenty years from that date.
