Scheduling of the Initial and Annual Performance Tests. Upon achieving Commercial Operation, the Seller shall give the Department five business days notice before the commencement of the performance test. A capacity and heat rate test of each Unit shall be performed. This performance test shall be paid for by the Seller. Annually in accordance with Section 4.02 (b), a heat rate test shall be performed within thirty days before or after the anniversary of the Commercial Operation Date, or at another time to be mutually agreed. The Seller shall provide 10 business day notice to the Department before the commecement of this performance test. This performance test shall be paid for by the Seller. Periodically in accordance with Section 2.02 (c), the Departement may call for additional performance tests in addition to the required annual test for the determination of Rated Capacity. The incremental costs of this test shall be born by the Department. The Seller shall give the Departement 10 business days notice before the commencement of the performance test.
