Common use of Schlumberger’s Exclusivity Clause in Contracts

Schlumberger’s Exclusivity. ERF represents that it has not granted the right to resell the ERF Technology in the Oil and Gas Sector to any third party or executed any other agreement with a third party that may infringe upon the rights granted to Schlumberger herein and agrees that it will not use, sell, or otherwise distribute, or authorize any third party to use, sell or otherwise distribute within the Territory, the ERF Technology or any other existing products or technology that ERF might possess upon the Effective Date in the Oil and Gas Sector during the term of this Agreement.
