Common use of Scope and Persons Bound Clause in Contracts

Scope and Persons Bound. This agreement supersedes and replaces the Adelaide Festival Centre, Professional and Administration Agreement 2003 and provides the terms and conditions of employment relating to professional and administrative employees employed by the Adelaide Festival Centre Trust (typically these employees are regarded as “fortnightly paid” employees). This agreement is made pursuant to Part 2 Section 79 of the Fair Work Act 1994. This Agreement shall be binding on the Adelaide Festival Centre Trust, the Union and all persons employed by the Trust to perform work covered by the classifications listed in Schedule B but excluding: • Management of the Trust • Trainees employed by the Commissioner for Public Employment under the National Training Wage Award • Employees whose terms and conditions are subject to a fixed term contract that specifies a separate salary review. This agreement is to read in conjunction with the Clerks (SA) Award (the Award). Where there is any inconsistency between this Agreement and the Award this Agreement shall take precedent.
