Common use of SCOPE OF CONCESSION Clause in Contracts

SCOPE OF CONCESSION. A. Concessionaire shall be granted, under a Concession Agreement (“Agreement”), the right to dispense food, non-alcoholic beverages, and novelties (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Recreation Area. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. C. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Failure on the part of Concessionaire to obtain Department-written approval to operate the mobile cart shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of the Agreement. Concessionaire shall be authorized to store the mobile unit overnight on the Concession Premises, as designated in Exhibit A. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Permissible types of food and non-alcoholic beverages include, but are not limited to, a combination of items in each of the following categories: 1) Hot Food: hot dogs, hamburgers, french fries, chicken nuggets, etc.

SCOPE OF CONCESSION. A. Concessionaire shall be granted, under a Concession Agreement (“Agreement”), the non- exclusive, revocable right to dispense food, non-alcoholic beverages, and novelties from a fully-equipped, completely self-contained mobile retail food unit (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Recreation Area. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of the Agreement. Concessionaire shall be authorized to store the mobile unit overnight on the Concession Premises, as designated in Exhibit A. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. C. Concessionaire may request Department-written approval to operate a mobile ice cream/beverage cart (“mobile cart”) along the Department-Designated Area set forth in Exhibit A. Failure on the part of Concessionaire to obtain Department-written approval to operate the mobile cart shall be a material breach of this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 9 and 10. Concessionaire shall be granted, under a this Concession Agreement (“Agreement”), the exclusive right to dispense food, nonoperate and maintain coin-alcoholic beverages, and novelties operated binocular machines (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Recreation Area). Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes purposes, as specified in Subparagraph 1(B) and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall be authorized, as part operate at the following State Park Service locations (“Areas”) and shall not exceed the designated number of coin-operated binocular machines without the Concession Operation, written pre-approval of Department: (i) Barnegat Lighthouse State Park – not to sell food and nonexceed five (5) machines (ii) Cape May Point State Park – not to exceed two (2) machines (iii)Fort Xxxx State Park – not to exceed two (2) machines (iv) High Point State Park – not to exceed six (6) machines (v) Liberty State Park – not to exceed eighteen (18) machines (vi) Twin Lights Historic Site – not to exceed one (1) machine The installation and/or removal of all coin-alcoholic beverages. Concessionaire operated binocular machines at the Department- Approved Stationing Areas set forth in Exhibit A shall be solely responsible for obtaining all necessary State licensespre-approved, inspections and approvals before selling food and non-alcoholic beveragesin writing, by Department. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals written pre-approval for the sale installation and/or removal of food and nonall coin-alcoholic beverages operated binocular machines at the Areas shall be a material breach of the Agreement, this Agreement subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 7 and 11. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. D. Concessionaire’s operation and this Agreement shall not be construed so as to affect the privileges accorded to the public’s use of the Areas. Permissible types Concessionaire’s operation shall not be construed so as to restrain or prevent individual persons or groups of food persons from bringing their own binocular or viewing equipment into the Areas. E. Concessionaire shall use the Concession Premises solely for the purposes set forth above and non-is strictly prohibited from selling or permitting the sale or consumption of any alcoholic beverages includethereon. F. Concessionaire’s status shall be that of a licensee. Concessionaire, but are not limited towhose term on the Concession Premises shall be seasonal in nature, a combination of items will not, in each of any way whatsoever, be granted or conveyed any permanent easement, lease, fee, or other interest in the following categories: 1) Hot Food: hot dogs, hamburgers, french fries, chicken nuggets, etcConcession Premises.

SCOPE OF CONCESSION. A. Concessionaire shall be granted, under a this Concession Agreement (“Agreement”), the non- exclusive, revocable right to dispense food, non-alcoholic beverages, and novelties from a fully-equipped, completely self-contained mobile retail food unit (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Recreation AreaXxxxxxxx State Xxxxxx. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by the Department of Environmental Protection (“Department”) for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of this Agreement. Concessionaire shall be authorized to store the mobile unit overnight on the Concession Premises, as designated in Exhibit A. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-non- alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections inspections, and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. C. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be granted, under a this Concession Agreement (“Agreement”), the right to conduct theatrical performances, and to dispense prepackaged food, non-prepackaged non- alcoholic beverages, and novelties (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Recreation AreaWashington Crossing State Park. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall, as part of the Concession Operation, conduct theatrical performances including, but not limited to, theatrical plays, musicals and concerts (“theatrical performances”) at the Open Air Theatre, specifically designated in Exhibits A and B. A minimum of one (1) theatrical performance must be historical in content and pertain to the Revolutionary War era. Concessionaire shall submit to Department, for approval, a written schedule and price list for all theatrical performances prior to commencement of any Period of Operation. Failure on the part of Concessionaire to obtain written pre-approval of the schedule and pricing for all theatrical performances shall be a material breach of this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 9 and 10. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell prepackaged food and non-alcoholic beverages. beverages at the snack bar, specifically designated in Exhibit B. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling prepackaged food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of prepackaged food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Permissible types of prepackaged food and non-alcoholic beverages include, but are not limited to, a combination of items in each of the following categories: 1) Prepackaged Food: wrapped or bagged sandwiches, candy, nuts, pretzels, etc., 2) Prepackaged Non-Alcoholic Beverages: bottled or canned soda, water, juice, etc. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all prepackaged food, prepackaged non-alcoholic beverages, and novelty items. Concessionaire shall be authorized, as not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre- approval of the types and pricing of prepackaged food, prepackaged non-alcoholic beverages, and novelty items shall be a material breach of this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 9 and 10. E. Concessionaire is prohibited from preparing and selling food on the Concession Operation, Premises. Concessionaire may request Department approval to prepare and sell food. If approved in writing by Department, Concessionaire may prepare and sell food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 11. C. 10. Concessionaire shall submit to Department, a written menu with prices for all prepared food for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing, by Department prior to sale. Failure on the part of Concessionaire to obtain Department written pre-pre- approval of the types and pricing of food, non-alcoholic beverages, and novelty items prepared food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. F. Concessionaire’s operation and this Agreement shall not be construed so as to affect the privileges accorded to the public’s use of the Area. Permissible types Concessionaire’s operation shall not be construed so as to restrain or prevent individual persons or groups of persons from bringing their own food and non-beverages into the Area. G. Concessionaire must maintain a physical staff presence at the Concession Premises while the Concession is open for business. Failure on the part of Concessionaire to maintain a staff presence at the Concession Premises while the Concession is open for business shall constitute a material breach of this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 9 and 10. H. Concessionaire shall use the Concession Premises solely for the purposes set forth above and is strictly prohibited from selling or permitting the sale or consumption of any alcoholic beverages includethereon. Concessionaire may request Department-written approval to sell or allow consumption of alcoholic beverages during scheduled theatrical performances. If approved in writing by Department, but are not limited toConcessionaire may sell and allow consumption of alcoholic beverages during scheduled theatrical performances at the Department-Designated Area set forth in Exhibit C, only after obtaining the necessary Alcoholic Beverage Commission (ABC) permits and approvals. Concessionaire shall submit to Department, for approval, a combination written list of items and prices for all alcoholic beverages, prior to sale. The sale or consumption of alcohol without the required Department-written approvals and ABC permits shall be a material breach of this Agreement, subject to Suspension of Operations and/or Termination in each accordance with the terms and conditions set forth in Paragraphs 9 and 10. The sale or consumption of alcoholic beverages outside of the following categories: 1Department- Designated Area set forth in Exhibit C shall be a material breach of this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 9 and 10. Concessionaire is expected to perform under this Agreement regardless of its ability to obtain a liquor license. Failure to obtain a liquor license does not negate or void this Agreement in any way. I. The storage of supplies, goods, or equipment is only permitted at the Concession Premises, as designated in Exhibit B. Concessionaire shall not be authorized to store any supplies, goods or equipment related to the operation of the Concession outside any Term of the Agreement. Concessionaire shall remove all supplies, goods, and equipment from the Area within the designated ten (10) Hot Food: hot dogsday “take-down” period set forth in Subparagraph 7(A). J. Concessionaire shall not install, hamburgersoperate, french friesor allow the installation or operation of vending machines on the Concession Premises. K. Concessionaire’s status shall be that of a licensee. Concessionaire, chicken nuggetswhose term on the Concession Premises shall be seasonal in nature, etcwill not, in any way whatsoever, be granted or conveyed any permanent easement, lease, fee, or other interest in the Concession Premises.

Concessionaire shall, as part of the Concession Operation, conduct theatrical performances including, but not limited to, theatrical plays, musicals and concerts (“theatrical performances”) at the Open Air Theatre, specifically designated in Exhibits A and B. A minimum of one (1) theatrical performance must be historical in content and pertain to the Revolutionary War era. Concessionaire shall submit to Department, for approval, a written schedule and price list for all theatrical performances prior to commencement of any Period of Operation. Failure on the part of Concessionaire to obtain written pre-approval of the schedule and pricing for all theatrical performances shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall submit a written menu with prices for all prepared food for approval, in writing, by Department prior to sale. Failure on the part of Concessionaire to obtain written pre-approval of the types and pricing of prepared food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. C. F. Concessionaire’s operation and the Agreement shall not be construed so as to affect the privileges accorded to the public’s use of the Area. Concessionaire’s operation shall not be construed so as to restrain or prevent individual persons or groups of persons from bringing their own food and beverages into the Area. G. Concessionaire must maintain a physical staff presence at the Concession Premises while the Concession is open for business. Failure on the part of Concessionaire to maintain a staff presence at the Concession Premises while the Concession is open for business shall constitute a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. H. Concessionaire shall use the Concession Premises solely for the purposes set forth above and is strictly prohibited from selling or permitting the sale or consumption of any alcoholic beverages thereon. Concessionaire may request Department-written approval to sell or allow consumption of alcoholic beverages during scheduled theatrical performances. If approved in writing by Department, Concessionaire may sell and allow consumption of alcoholic beverages during scheduled theatrical performances at the Department-Designated Area set forth in Exhibit C, only after obtaining the necessary Alcoholic Beverage Commission (ABC) permits and approvals. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, prior to sale. The sale or consumption of alcohol without the required Department-written approvals and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items ABC permits shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Permissible types The sale or consumption of food and non-alcoholic beverages include, but are not limited to, a combination of items in each outside of the following categories: 1Department- Designated Area set forth in Exhibit C shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire is expected to perform under the Agreement regardless of its ability to obtain a liquor license. Failure to obtain a liquor license does not negate or void the Agreement in any way. I. The storage of supplies, goods, or equipment is only permitted at the Concession Premises, as designated in Exhibit B. Concessionaire shall not be authorized to store any supplies, goods or equipment related to the operation of the Concession outside any Term of the Agreement. Concessionaire shall remove all supplies, goods, and equipment from the Area within the designated ten (10) Hot Food: hot dogsday “take-down” period set forth in Subparagraph 8(A). J. Concessionaire shall not install, hamburgersoperate, french friesor allow the installation or operation of vending machines on the Concession Premises. K. Concessionaire’s status shall be that of a licensee. Concessionaire, chicken nuggetswhose term on the Concession Premises shall be seasonal in nature, etcwill not, in any way whatsoever, be granted or conveyed any permanent easement, lease, fee, or other interest in the Concession Premises.

SCOPE OF CONCESSION. A. Concessionaire shall be granted, under a this Concession Agreement (“Agreement”), the right to dispense food, non-alcoholic beverages, and novelties (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Round Valley Recreation Area. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. C. Concessionaire may request Department-written approval to operate a mobile ice cream/beverage cart (“mobile cart”) along the Department-Designated Area set forth in Exhibit A. Failure on the part of Concessionaire to obtain Department-written approval to operate the mobile cart shall be a material breach of this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 9 and 10. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Permissible types of food and non-alcoholic beverages include, but are not limited to, a combination of items in each of the following categories: 1) Hot Food: hot dogs, hamburgers, french fries, chicken nuggets, etc.

SCOPE OF CONCESSION. A. Concessionaire shall be grantedshall, under a this Concession Agreement (“Agreement”), be the right to dispense food, non-alcoholic beverages, and novelties renter of stand up paddleboards (“paddleboards”) at Monksville Reservoir (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Recreation Area). Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire No overnight storage is provided on or about the Concession Premises and all paddleboards, supplies, goods, and equipment shall be authorizedremoved from the Area on a daily basis. For the Initial Term and any subsequent Renewal Term(s) of this Agreement, Concessionaire shall, at its sole cost and expense, be permitted to install one (1) steel shipping container (“shipping container”) for Concession storage, within a pre-determined portion of the Area, as part of designated in Exhibit A. The shipping container shall be uniform in color and the Concession Operationmaximum allowable size shall be twenty feet (20′) in length, to sell food eight feet (8′) in width, and non-alcoholic beverageseight feet six inches (8′6′′) in height. Concessionaire shall be solely responsible submit to Department, for obtaining all necessary State licensesapproval, inspections a written description, including but not limited to, the size and approvals before selling food and noncolor of the proposed shipping container. Concessionaire shall not purchase and/or install the proposed shipping container without Department-alcoholic beverageswritten pre-approval. Failure on The installation of any shipping container without Department written pre-approval and/or the part installation of Concessionaire any shipping container that does not conform to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages requirements set forth in this Paragraph shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. For the Initial Term of this Agreement, the Department-approved shipping container shall be installed on the Concession Premises as soon as practicable after the Effective Date of this Agreements Initial Term and shall be removed within the seven (7) day “take-down” period after October 31st. For any subsequent Renewal Term(s) of this Agreement, the Department-approved shipping container shall be installed on the Concession Premises within the seven (7) day “set-up” period prior to April 1st and removed within the seven (7) day “take-down” period after October 31st, as set forth in Subparagraph 6(B). Concessionaire shall be authorized, as part of restore the Concession OperationPremises to its condition prior to installation. C. Concessionaire’s operation and this Agreement shall not be construed so as to affect the privileges accorded to the public’s use of Long Pond Ironworks State Park (“Area”), including public use of Monksville Reservoir and the Concession Premises. Concessionaire’s operation shall not be construed so as to prepare foodrestrain or prevent individual persons or groups of persons from bringing their own paddleboards and recreational equipment, or from bringing paddleboards and recreational equipment rented from other paddleboard operations outside the Area, into the Area, including onto Monksville Reservoir and the Concession Premises. D. Concessionaire shall be responsible for establishing a telephone, web based reservation system and website. The system shall be capable of making electronic reservations to schedule paddleboard rentals. Concessionaire shall be solely responsible provide Department with read only access to the reservation system for obtaining purposes of monitoring Concessionaire activity at the Area. Concessionaire shall include the website information in all necessary State licensespublished Concession materials and advertisements and prominently display same at the Concession Premises. E. Concessionaire must maintain a physical staff presence at the Concession Premises while the Concession is open for business and while paddleboards are in use on the Lake/Reservoir. Concessionaire must maintain a minimum of one (1) concession employee that is American Red Cross certified in the proper administration of Cardiopulmonary Resuscitation (“CPR”), inspections First Aid, and approvals before preparing foodLifeguarding, at the Concession Premises, while the Concession is open for business and while paddleboards are in use on the Lake/Reservoir. Failure on the part of Concessionaire to obtain maintain a staff presence and maintain a minimum of one (1) concession employee that is certified in the State Licensesproper administration of CPR, inspectionsFirst Aid, and approvals Lifeguarding, at the Concession Premises, while the Concession is open for business and while paddleboards are in use on the preparation of food Lake/Reservoir shall be constitute a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. F. All Concession customers must receive a properly rated and sized Personal Flotation Device (PFD). All paddleboard rental customers twelve (12) and under must wear a PFD. It is the responsibility of Concessionaire to ensure compliance with the wearing of PFDs. All PFDs must be in serviceable condition with the proper Coast Guard rating and tags, and may not exhibit deterioration that could diminish performance. Any damaged PFDs or PFDs without proper valid tags must be removed from the Area and may not be used by Concessionaire or Concessionaire’s customers. Concessionaire is responsible for ensuring that rented paddleboards are not overloaded. The proper number of customers on a paddleboard must be based on paddleboard type, volume, and the manufacturer’s recommended weight capacity. Concessionaire is solely responsible for routinely inspecting all paddleboards to ensure that they are safe and free of defects. All paddleboards determined to be unsafe or damaged must be removed from the Area and may not be used by Concessionaire or Concessionaire’s customers until properly repaired. Paddleboard repair is not permitted in the Area; any and all repairs must occur off-site. Concessionaire is solely responsible for the safety of all paddleboards and customers. G. All rented paddleboards may only be operated on Monksville Reservoir. Concessionaire shall instruct all customers that rented paddleboards may only be operated on Monksville Reservoir. Specifically, Concessionaire shall not permit customers to operate paddleboards on any adjacent waterbodies including, but not limited to, the Wanaque Reservoir. H. Concessionaire’s Operation shall be strictly limited to the rental of paddleboards. Concessionaire may request Department-written approval to rent related equipment. If approved in writing by Department, Concessionaire may rent related equipment at the Area and shall comply with all rules of the terms and regulations promulgated by conditions of this Agreement. Concessionaire shall submit to Department, for approval, a written list of items and prices for all related equipment. Concessionaire shall not rent any related equipment until Department approves the New Jersey State Department of Health proposed items and any other agency of government with oversight over food preparation and serviceprices in writing. Failure on the part of Concessionaire to comply with all such rules obtain written pre-approval of the types and regulations pricing of related equipment shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. C. I. Concessionaire shall submit use the Concession Premises solely for the purposes set forth above and is strictly prohibited from selling or permitting the sale or consumption of any alcoholic beverages thereon. J. Concessionaire’s status shall be that of a licensee. Concessionaire, whose term on the Concession Premises shall be seasonal in nature, will not, in any way whatsoever, be granted or conveyed any permanent easement, lease, fee, or other interest in the Concession Premises. K. Department reserves the right to Departmentissue Special Use Permits for public education programs for the promotion of natural, recreational and historic resources. Department shall coordinate with Concessionaire to minimize interruption of the Concession Operation and impacts to the Concession Premises. Specifically, for approvalthe Initial Term and any subsequent Renewal Term(s) Concessionaire shall be prohibited from operating the Concession at the Concession Premises during one (1) weekend in the month of September, dates tentative. Concessionaire may request Department-written approval from the Area Superintendent to operate the Concession at the North Boat Launch, specifically designated in Exhibit B. If approved in writing by the Area Superintendent, Concessionaire shall be authorized to operate the Concession within a written list pre-determined portion of items and prices for all foodthe Area at the North Boat Launch, nonduring the Department-alcoholic beveragesdesignated weekend, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination operate in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of this Agreement. No overnight storage is provided and the mobile unit must be removed from the Area on a daily basis, unless otherwise approved, in writing, by Department. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of this Agreement. Concessionaire shall be authorized to store the mobile unit overnight on the Concession Premises, as designated in Exhibit A. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Permissible types of food and non-alcoholic beverages include, but are not limited to, a combination of items in each of the following categories: 1) Hot Food: hot dogs, hamburgers, french fries, chicken nuggets, etc.

SCOPE OF CONCESSION. A. Concessionaire shall be granted, under a this Concession Agreement (“Agreement”), the right to dispense food, non-alcoholic beverages, and novelties (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Atsion Recreation Area. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. C. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of the Agreement. Concessionaire shall be authorized to store the mobile unit overnight on the Concession Premises, as designated in Exhibit A. Concessionaire shall have the ability to serve a wide variety of food and non-alcoholic beverage options to large groups of patrons, specifically, but not limited to, bus groups, etc. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. C. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. The Concession Agreement shall extend only to those activities undertaken by authorized employees, volunteers, and agents of the Concession Operation (collectively and severally included in "Concessionaire”). B. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-non- alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections inspections, and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. C. Concessionaire may request Department-written approval to operate a mobile ice cream/beverage cart (“mobile cart”) along the Department-Designated Area set forth in Exhibit A. Failure on the part of Concessionaire to obtain Department-written approval to operate the mobile cart shall be a material breach of this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 9 and 10. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Permissible types of food and non-alcoholic beverages include, but are not limited to, a combination of items in each of the following categories: 1) Hot Food: hot dogs, hamburgers, french fries, chicken nuggets, etc.

SCOPE OF CONCESSION. A. Concessionaire shall be granted, under a the Concession Agreement (“Agreement”), the exclusive right to dispense food, nonoperate and maintain coin-alcoholic beverages, and novelties operated binocular machines (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Recreation Area). Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes purposes, as specified in Subparagraph 1(B) and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall be authorized, as part operate at the following State Park Service locations (“Areas”) and shall not exceed the designated number of coin-operated binocular machines without the Concession Operation, written pre-approval of Department: (i) Barnegat Lighthouse State Park – not to sell food and nonexceed five (5) machines (ii) Cape May Point State Park – not to exceed two (2) machines (iii)Fort Xxxx State Park – not to exceed two (2) machines (iv) High Point State Park – not to exceed six (6) machines (v) Liberty State Park – not to exceed eighteen (18) machines (vi) Twin Lights Historic Site – not to exceed one (1) machine The installation and/or removal of all coin-alcoholic beverages. Concessionaire operated binocular machines at the Department- Approved Stationing Areas set forth in Exhibit A shall be solely responsible for obtaining all necessary State licensespre-approved, inspections and approvals before selling food and non-alcoholic beveragesin writing, by Department. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals written pre-approval for the sale installation and/or removal of food all coin-operated binocular machines at the Areas shall be a material breach of the Agreement subject to Suspension of Operations and/or Termination in accordance with the terms and nonconditions set forth in Paragraphs 7 and 8. C. Concessionaire shall submit to Department, for approval, a written list of prices for all coin- operated binocular machines. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain written pre-alcoholic beverages approval of the pricing for all coin-operated binocular machines shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 7 and 118. D. Concessionaire’s operation and the Agreement shall not be construed so as to affect the privileges accorded to the public’s use of the Areas. Concessionaire’s operation shall not be construed so as to restrain or prevent individual persons or groups of persons from bringing their own binocular or viewing equipment into the Areas. E. Concessionaire shall be authorized, as part of use the Concession Operation, to prepare food. Concessionaire Premises solely for the purposes set forth above and is strictly prohibited from selling or permitting the sale or consumption of any alcoholic beverages thereon. F. Concessionaire’s status shall be solely responsible for obtaining all necessary State licensesthat of a licensee. Concessionaire, inspections and approvals before preparing food. Failure whose term on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food Concession Premises shall be a material breach of seasonal in nature, will not, in any way whatsoever, be granted or conveyed any permanent easement, lease, fee, or other interest in the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11Concession Premises. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail ice cream unit (“mobile unit”), sufficient to satisfy the requirements of this Agreement. Concessionaire shall be authorized to store the mobile unit overnight on the Concession Premises, as designated in Exhibit A. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food ice cream and non-alcoholic beverages. Ice cream shall include, but not be limited to, hard ice cream, water ice, shaved ice, soft serve, gelato, frozen yogurt etc. (“ice cream”). Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food ice cream and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food ice cream and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all ice cream, non-alcoholic beverages, and novelty items. Concessionaire shall be authorized, as not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the Concession Operationtypes and pricing of ice cream, non-alcoholic beverages, and novelty items shall be a material breach of this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 9 and 10. Permissible types of ice cream and non-alcoholic beverages include, but are not limited to, hard ice cream, water ice, shaved ice, soft serve, gelato, frozen yogurt, soda, juice, water, etc. E. Concessionaire may request Department-written approval to prepare and sell food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing and selling food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation and sale of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 11. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. C. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beveragesbeverage, and novelty items. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of this Agreement. Concessionaire shall be authorized to store the mobile unit overnight on the Concession Premises, as designated in Exhibit A. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-non- alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections inspections, and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. C. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of this Agreement. No overnight storage is provided and the mobile unit must be removed from the Area on a daily basis, unless otherwise approved, in writing, by Department. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Concessionaire shall have the ability to serve a wide variety of food and non-alcoholic beverage options to large groups of patrons, specifically, but not limited to, bus groups, etc. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the this Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 9 and 1110. Concessionaire shall be granted, under a Concession Agreement (“Agreement”), the non- exclusive, revocable right to dispense food, non-alcoholic beverages, and novelties from a fully-equipped, completely self-contained mobile retail food unit (hereinafter referred to as the “Concession Operation”) at Shepherd Lake Recreation AreaBatsto Village Historic Site. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail food unit (“mobile unit”), sufficient to satisfy the requirements of the Agreement. No overnight storage is provided and the mobile unit must be removed from the Area on a daily basis, unless otherwise approved, in writing, by Department. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food and non-alcoholic beverages. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food and non-alcoholic beverages shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall be authorized, as part of the Concession Operation, to prepare food. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. C. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Concessionaire’s operation shall be limited to the structure(s) or area(s) provided by Department for concession purposes and specifically designated in Exhibit A (hereinafter referred to as the “Concession Premises”). B. Concessionaire shall, at its sole cost and expense, provide a fully equipped, completely self- contained mobile retail ice cream unit (“mobile unit”), sufficient to satisfy the requirements of the Agreement. Concessionaire shall be authorized to store the mobile unit overnight on the Concession Premises, as designated in Exhibit A. C. Concessionaire shall be authorized, as part of the Concession Operation, to sell food ice cream and non-alcoholic beverages. Ice cream shall include, but not be limited to, hard ice cream, water ice, shaved ice, soft serve, gelato, frozen yogurt etc. (“ice cream”). Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before selling food ice cream and non-alcoholic beverages. Failure on the part of Concessionaire to obtain and maintain the State licenses, inspections, and approvals for the sale of food ice cream and non-alcoholic beverages shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all ice cream, non-alcoholic beverages, and novelty items. Concessionaire shall be authorized, as not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation and sale of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall be solely responsible for obtaining all necessary State licenses, inspections and approvals before preparing food. Failure on the part of Concessionaire to obtain and maintain the State Licenses, inspections, and approvals for the preparation of food shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Concessionaire shall comply with all rules and regulations promulgated by the New Jersey State Department of Health and any other agency of government with oversight over food preparation and service. Failure on the part of Concessionaire to comply with all such rules and regulations shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. C. D. Concessionaire shall submit to Department, for approval, a written list of items and prices for all food, non-alcoholic beverages, and novelty items. Concessionaire shall not commence any operations until Department approves the proposed prices in writing. Failure on the part of Concessionaire to obtain Department written pre-approval of the types and pricing of food, non-alcoholic beverages, and novelty items shall be a material breach of the Agreement, subject to Suspension of Operations and/or Termination in accordance with the terms and conditions set forth in Paragraphs 10 and 11. Permissible types of food and non-alcoholic beverages include, but are not limited to, a combination of items in each of the following categories: 1) Hot Food: hot dogs, hamburgers, french fries, chicken nuggets, etc.
