Common use of Scope of Obligations Clause in Contracts

Scope of Obligations. 3.10.1 Notwithstanding anything to the contrary contained herein, AT&T-21STATE’s obligations under this Agreement shall apply only to: 3.10.1.1 The specific operating area(s) or portion thereof in which AT&T-21STATE is then deemed to be the ILEC under the Act (the “ILEC Territory”); and 3.10.1.2 Assets that AT&T-21STATE owns or leases and which are used in connection with AT&T- 21STATE’s provision to WSP of any Interconnection products and/or services provided or contemplated under this Agreement, the Act or any tariff or ancillary agreement referenced herein (individually and collectively, the “ILEC Assets”). 3.10.2 This Agreement sets forth the terms and conditions pursuant to which AT&T-21STATE agrees to provide WSP with access to Interconnection under Section 251(c)(2) in AT&T-21STATE’s incumbent local Exchange Areas for the provision of WSP’s Telecommunications Services. The Parties acknowledge and agree that AT&T-21STATE is only obligated to make available Interconnection under Section 251(c)(2) to WSP in AT&T- 21STATE’s incumbent local Exchange Areas. Therefore, the Parties understand and agree that the rates, terms and conditions, including references to tariff rates, terms and conditions, set forth in this Agreement shall only apply to the Parties and be available to WSP for provisioning Telecommunication Services within an AT&T-21STATE incumbent local Exchange Area(s) in the state in which this Agreement has been approved by the relevant state Commission and is in effect.

The Parties acknowledge and agree that AT&T-21STATE is only obligated to make available Interconnection under Section 251(c)(2) to WSP in AT&T- 21STATEAT&T-21STATE’s incumbent local Exchange Areas. Therefore, the Parties understand and agree that the rates, terms and conditions, including references to tariff rates, terms and conditions, set forth in this Agreement shall only apply to the Parties and be available to WSP for provisioning Telecommunication Page 19 of 339 Contract Id: 8363332 Services within an AT&T-21STATE incumbent local Exchange Area(s) in the state in which this Agreement has been approved by the relevant state Commission and is in effect.

The Parties acknowledge and agree that AT&T-21STATE is only obligated to make available Interconnection under Section 251(c)(2) to WSP in AT&T- 21STATE’s incumbent local Exchange Areas. Therefore, the Parties understand and agree that the rates, terms and conditions, including references to tariff rates, terms and conditions, set forth in this Agreement shall only apply to the Parties and be available to WSP for provisioning Telecommunication Services within an AT&T-21STATE incumbent local Exchange Area(s) in the state in which this Agreement has been approved by the relevant state Commission and is in effect.

Scope of Obligations. 3.10.1 2.5.1 Notwithstanding anything to the contrary contained herein, AT&T-21STATESBC ILLINOIS’s obligations under this Agreement shall apply only to: 3.10.1.1 The 2.5.1.1 the specific operating area(s) or portion thereof in which AT&T-21STATE SBC ILLINOIS is then deemed to be the ILEC under the Act (the “ILEC Territory”); and, and only to the extent that the CLEC is operating and offering telecommunications service (as defined in the Act) to End Users identified to be residing in such ILEC Territory, it being explicitly understood by the Parties that SBC ILLINOIS’s obligations under this Agreement apply only to Resale Services by CLEC within (and not extending beyond) SBC ILLINOIS’s incumbent local exchange areas, and that SBC ILLINOIS is not obligated to provision Resale Services or provide any other rights under Section 251(c) of the Act outside of SBC ILLINOIS’s incumbent local exchange areas. 3.10.1.2 Assets 2.5.1.2 assets that AT&T-21STATE SBC ILLINOIS owns or leases and which are used in connection with AT&T- 21STATESBC ILLINOIS’s provision to WSP CLEC of any Interconnection Resale Services, functions, facilities, products and/or or services provided or contemplated under this Agreement, the Act or any tariff or ancillary agreement referenced herein (individually and collectively, the “ILEC Assets”).; and 3.10.2 This Agreement sets forth the terms and conditions pursuant to which AT&T-21STATE agrees to provide WSP with access to Interconnection under Section 251(c)(2) in AT&T-21STATE’s incumbent local Exchange Areas for the provision of WSP’s Telecommunications Services2.5.1. The Parties acknowledge and agree that AT&T-21STATE is only obligated to make available Interconnection under Section 251(c)(2) to WSP in AT&T- 21STATE’s incumbent local Exchange Areas. Therefore, the Parties understand and agree that the rates, terms and conditions, including references to tariff rates, terms and conditions, set forth in this Agreement shall only apply to the Parties 3 and be available to WSP CLEC for provisioning Telecommunication Services purchasing services within an AT&T-21STATE SBC ILLINOIS incumbent local Exchange Area(sexchange area(s) in the state State in which this Agreement has been approved by the relevant state Commission and is in effect, and only where CLEC has been certified as a local exchange carrier by the Commission and is authorized to provide the services it has contracted to provide herein.

Scope of Obligations. 3.10.1 2.5.1 Notwithstanding anything to the contrary contained herein, AT&T-21STATEAT&T-21ASTATE’s obligations under this Agreement shall apply only to: 3.10.1.1 The 2.5.1.1 the specific operating area(s) or portion thereof in which AT&T-21STATE is then deemed to be the ILEC under the Act (the “ILEC Territory”); and, and only to the extent that the CLEC is operating and offering telecommunications service (as defined in the Act) to End Users identified to be residing in such ILEC Territory, it being explicitly understood by the Parties that AT&T- 21STATE’s obligations under this Agreement apply only to Resale Services by CLEC within (and not extending beyond) AT&T-21STATE’s incumbent local exchange areas, and that AT&T- 21STATE is not obligated to provision Resale Services or provide any other rights under Section 251(c) of the Act outside of AT&T-21STATE’s incumbent local exchange areas. 3.10.1.2 Assets 2.5.1.2 assets that AT&T-21STATE owns or leases and which are used in connection with AT&T- 21STATE’s provision to WSP CLEC of any Interconnection Resale Services, functions, facilities, products and/or or services provided or contemplated under this Agreement, the Act or any tariff or ancillary agreement referenced herein (individually and collectively, the “ILEC Assets”).; 3.10.2 This Agreement sets forth the terms and conditions pursuant to which AT&T-21STATE agrees to provide WSP with access to Interconnection under Section 251(c)(2) in AT&T-21STATE’s incumbent local Exchange Areas for the provision of WSP’s Telecommunications Services. The Parties acknowledge and agree that AT&T-21STATE is only obligated to make available Interconnection under Section 251(c)(2) to WSP in AT&T- 21STATE’s incumbent local Exchange Areas. Therefore, the Parties understand and agree that the rates, terms and conditions, including references to tariff rates, terms and conditions, set forth in this Agreement shall only apply to the Parties 2.5.1.3 and be available to WSP CLEC for provisioning Telecommunication Services purchasing services within an AT&T-21STATE incumbent local Exchange Area(sexchange area(s) in the state State in which this Agreement has been approved by the relevant state Commission and is in effect, and only where CLEC has been certified as a local exchange carrier by the Commission and is authorized to provide the services it has contracted to provide herein.

The Parties acknowledge and agree that AT&T-21STATE is only obligated to make available Interconnection under Section 251(c)(2) to WSP in AT&T- 21STATEAT&T-21STATE’s incumbent local Exchange Areas. Therefore, the Parties understand and agree that the rates, terms and conditions, including references to tariff rates, terms and conditions, set forth in this Agreement shall only apply to the Parties and be available to WSP for provisioning Telecommunication CN:03292017-7376 000017 Services within an AT&T-21STATE incumbent local Exchange Area(s) in the state in which this Agreement has been approved by the relevant state Commission and is in effect.
