Common use of Scope of Warranty Clause in Contracts

Scope of Warranty. (a) The warranty set forth in this Section 7 shall not apply: (i) if the Software is not used in accordance with the Documentation; or (ii) unless otherwise agreed to in writing by the parties to any Extensions or Modifications; or (iii) if the defect is caused by a Modification or Extension, Licensee, or a third-party software malfunction.
