Common use of Seat of Arbitration Clause in Contracts

Seat of Arbitration. Unless the Parties agree otherwise, the seat of arbitration shall be determined by the arbitral tribunal.

If the Disputing Parties agree otherwisefail to agree, the Tribunal shall determine the seat of arbitration in accordance with the applicable arbitration rules, provided that the seat of arbitration shall be determined by in the arbitral tribunalterritory of either Participant or a State that is a party to the New York Convention.
