Common use of Secured Party Representative Fees Clause in Contracts

Secured Party Representative Fees. In the event that the Secured Party Representative is required to take any action on behalf of the Secured Parties in enforcing the Secured Parties’ rights and remedies under this Agreement, the Secured Parties shall pay the Secured Party Representative a fee of 2% of all amounts collected by the Secured Party Representative (the “Representative Fee”). The Representative Fee shall be in addition to all third party fees and costs, including attorney fees and costs, incurred by Secured Party Representative in connection with the exercise of such remedies.

In the event that the Secured Party Representative is required to take any action on behalf of the Secured Parties in enforcing the Secured Parties’ ' rights and remedies under this Agreement, the Secured Parties shall pay the Secured Party Representative a fee of 2% of all amounts collected by the Secured Party Representative (the “"Representative Fee”"). The Representative Fee shall be in addition to all third party fees and costs, including attorney fees and costs, incurred by Secured Party Representative in connection with the exercise of such remedies.
