If Borrower shall be required to file reports with the Securities and Exchange Commission pursuant to Section 13(a) or 15(d) of the Securities Exchange Act of 1934, as amended, Borrower shall promptly upon its becoming available, provide Lender with one copy of each financial statement, report, notice or proxy statement sent by Borrower to stockholders generally, and, a copy of each regular or periodic report, and any registration statement, or prospectus in respect thereof, filed by Borrower with any securities exchange or with federal or state securities and exchange commissions or any successor agency.
Securities and Other Reports if Borrower or any Subsidiary Guarantor shall be required to file reports with the Securities and Exchange Commission pursuant to Section 13(a) or 15(d) of the Exchange Act, promptly upon its becoming available, one copy of each financial statement, report, notice or proxy statement sent by Borrower or any Subsidiary Guarantor to stockholders generally, and, a copy of each regular or periodic report, and any registration statement, or prospectus in respect thereof, filed by Borrower or any Subsidiary Guarantor with any securities exchange or with federal or state securities and exchange commissions or any successor agency;

If any Subsidiary of the Borrower becomes a publicly traded company, promptly upon its becoming available, one copy of each financial statement, report, notice or proxy statement sent by such party to stockholders generally, and a copy of each regular or periodic report, and any registration statement, or prospectus or any other document in respect thereof filed by such party with any securities exchange or with all federal or state securities and exchange commissions or any successor agency. In addition to the foregoing, the Borrower shall, promptly upon its becoming available, deliver to the Administrative Agent one copy of each regular or periodic report and any registration statement or prospectus and any other document filed by the Borrower with any securities exchange or with all federal or state securities and exchange commissions or any successor agency.
Securities and Other Reports if Borrower or any Surety shall be required to file reports with the Securities and Exchange Commission pursuant to Section 13(a) or 15(d) of the Securities Exchange Act of 1934, as amended, promptly upon its becoming available, one copy of each financial statement, report, notice or proxy statement sent by Borrower or such Surety to stockholders generally, and, a copy of each regular or periodic report, and any registration statement, or prospectus in respect thereof, filed by Borrower or such Surety with any securities exchange or with federal or state securities and exchange commissions or any successor agency, in which event the delivery to Lender of such financial statement, report, notice or proxy statement filed with the Securities Exchange Commission shall be accepted by Lender in satisfaction of Borrower’s obligations set forth in Section 6.9a.
