Common use of Securities Contract Clause in Contracts

Securities Contract. The parties hereto agree and acknowledge that (a) Buyer is a “financial institution” as such term is defined in Section 101(22) of Title 11 of the United States Code (the “Bankruptcy Code”) and (b) this Agreement is a “securities contract” as such term is defined in Section 741(7) of the Bankruptcy Code, and the parties hereto are entitled to the protections afforded by, among other Sections, sections 362(b)(6) and 555 of the Bankruptcy Code.

Securities Contract. The parties hereto agree and acknowledge recognize that (a) the Buyer is a “financial institution” as such term is defined in institution within the meaning of Section 101(22) of Title 11 of the United States Code (the “Bankruptcy Code”) and (b) "BANKRUPTCY CODE"). The parties hereto further recognize that this Agreement as supplemented by each Transaction Confirmation is a “securities contract” , as such term is defined in Section 741(7) of the Bankruptcy Code, and the parties hereto are entitled to the protections afforded by, among other Sections, sections 362(b)(6) and protection of Section 555 of the Bankruptcy Code.
