Common use of Security Safeguards Clause in Contracts

Security Safeguards. The Business Associate shall use appropriate safeguards and comply with Subpart C of 45 CFR Part 164, Security Standards to prevent the use or disclosure of Electronic Protected Health Information (ePHI), other than as authorized under this Agreement, and maintain a reasonable and appropriate privacy and security program that includes appropriate administrative, technical, organizational and physical safeguards to protect the confidentiality, integrity and availability of PHI that it creates, receives, maintains, or transmits on behalf of the Covered Entity.

Security Safeguards. The Business Associate shall use appropriate safeguards and comply with Subpart C of 45 CFR Part 164will implement, Security Standards to prevent the use or disclosure of Electronic Protected Health Information (ePHI), other than as authorized under this Agreementmaintain, and maintain a reasonable and appropriate privacy and security program that includes appropriate use administrative, technical, organizational and physical safeguards in compliance with the standards and implementation specifications of Security Rule §§ 164.308, 164.310, 164.312 and 164.316 so as to reasonably and appropriately protect the confidentiality, integrity integrity, and availability of PHI that it creates, receives, maintains, or transmits on behalf of ePHI as required by the Covered EntitySecurity Rule and HITECH.
