Confidentiality and Security. Section 1: Service Provider agrees that all of its employees, contractors, subcontractors, or associates will comply with all state and federal law and with TJJD policies regarding maintaining the confidentiality of TJJD youth, including, but not limited to, maintaining confidentiality of student records and identifying information.
Section 2: Service Provider agrees that all information regarding TJJD and/or its youth that is gathered, produced, or otherwise derived from this contract shall remain confidential and subject to release only by permission of TJJD.
Section 3: Service Provider’s employees, contractors, subcontractors, or associates who visit any TJJD facility will comply with that facility's security regulations.
Section 4: Identifying pictures, appearances, films, or reports of TJJD youth may not be disclosed by Service Provider without the written consent of TJJD, of the youth and, if under age 18, of the youth’s parent, guardian, or managing conservator.
Confidentiality and Security. 6.1. Each party acknowledges that all material and information which has or will come into the possession and knowledge of each in connection with this Agreement or the performance hereof, consists of confidential and proprietary data, whose disclosure to or use by third parties will be damaging. Both parties, therefore, agree to hold such material and information in strictest confidence, not to make use thereof other than for the performance of this Agreement, to release it only to employees requiring such information, and not to release or disclose it to any other party.
6.2. Each party agrees that in the event that confidential information which is the responsibility of either party is accidentally released by either party to the other, each party undertakes to inform the other upon discovery, to keep the information strictly confidential, and to return or destroy the information immediately without copying or onward transmitting that information.

(A) AAML and AAMAL agree that in the course of their dealing in accordance with the terms of the Agreements, they may give each other access to confidential or proprietary information (collectively, "Confidential Information"). Confidential Information may include but is not limited to (i) proprietary and confidential matters concerning security arrangements, financial information, technical data and any information relating to the pricing, methods, processes, lists, research development or related information to which a party may gain access to in connection with the Agreements; (ii) information belonging to the customers of AAMAL, including without limitation the names of customers and the nature of their accounts; and (iii) information belonging to a party's vendors or other suppliers of services. (B) The parties may disclose the terms of the Agreements to its related companies and professional advisers. The party receiving Confidential Information ("Receiving Party") shall limit disclosure of Confidential Information of the party disclosing Confidential Information ("Disclosing Party") only to its employees, agents and/or subcontractors, or to any market counterparty or any broker (in accordance with market practice) in relation to transactions undertaken for the Funds, or to the custodian who (a) need to know such Confidential Information for the purpose of the activities contemplated by the Agreements and (b) are under non-disclosure obligations at least as protective of the Confidential Information as those set out herein. The Receiving Party shall be responsible for any breach of the Agreements by the foregoing persons to whom Confidential Information is disclosed as if such breach were committed by the Receiving Party. Subject to the foregoing, each party agrees that it will not, without the prior written consent of the other party, disclose any Confidential Information to any third party orally or in writing.
(C) The non-disclosure obligations set out herein shall not apply to information which (a) is or becomes publicly available through no fault of the Receiving Party; (b) is or becomes in the Receiving Party's possession prior to disclosure by the Disclosing Party provided it is obtaine...
