Common use of Separation and Release Agreement Clause in Contracts

Separation and Release Agreement. Notwithstanding anything in Section 6 or Section 7 to the contrary and in consideration therefor, severance benefits thereunder will only become payable by the Company if the Executive executes and delivers to the Company a Separation and Release Agreement on or after the date of written notice of termination of Executive's employment and in substantially the form attached as an example in Exhibit A hereof. The terms of the Separation and Release Agreement will be subject to the terms of the Executive Employment Agreement.

Separation and Release Agreement. Furthermore, the Executive acknowledges that the severance benefits under Section 6 or Section 7 shall only become payable by the Company if the Executive executes and delivers to the Company a Separation and Release Agreement on or after the date of written notice of termination of Executive's employment and in substantially the form attached attached, as an example example, in Exhibit A hereof. The terms of the Separation and Release Agreement will be subject to the terms of the Executive Employment Agreement.
