Based on the monthly achievement the Qualified vLEI Issuer can gather on-line from the SLA Dashboard, if a breach on any Service Level Target is detected then the steps below listed should be initiated.
Service Level Breaches. CONTRACTOR hereby acknowledges and agrees that the Work and all services related to the AGREEMENT, including, but not limited to, the service requirements listed in Exhibit C, shall be of the highest caliber, performed in strict compliance with the requirements of the AGREEMENT, and remain consistent with the image that CITY seeks to project to all guests to and users of the AIRPORT. In the event that CONTRACTOR fails to meet the aforesaid standards or fails to duly perform in accordance with the terms and conditions of the AGREEMENT, CONTRACTOR hereby acknowledges and agrees that, in addition to all other rights and remedies available to CITY under the AGREEMENT, CONTRACTOR shall pay the corresponding liquidated damages as specified in Exhibit C. The amounts set forth in Exhibit C have been agreed upon by and between CITY and CONTRACTOR as reasonable estimates of CITY’S damages in such events. CITY’S acceptance of any damages pursuant to this Section 3.30 and Exhibit C will not prevent CITY from exercising any and all other rights or remedies for default available to CITY at law or in equity.
Service Level Breaches. Some services have a Service Level Agreement (SLA) attached to them that specify a monthly availability level or target TTRF that, if not achieved, will result in Service Credits being payable. Service Credits are provided in accordance with Section 2.11 of the Service Schedule.
