Common use of SERVICES OF NOTICE Clause in Contracts

SERVICES OF NOTICE. The Cardmember hereby agrees that the service of any notice or any legal process in respect of any claim arising out of or connected with this Agreement may be effected by forwarding a copy of the same by post to the Cardmember’s last known address stated in the Bank’s Card Application Form or to such other address notified by the Cardmember to the Bank from time to time and shall be deemed to have served at the time of posting of the Notice and in providing delivery it shall be sufficient to prove that the same was properly addressed and put in the post despite any evidence to the contrary.

SERVICES OF NOTICE. The Cardmember hereby agrees that the service of any notice or of any legal process (“the Notice”) in respect of any claim arising out of or connected with this Agreement may be effected by forwarding a copy of the same by post to the Cardmember’s last known address stated in the Bank’s Card Application Form or to such other address notified by the Cardmember to the Bank from time to time and Bank. The Notice shall be deemed to have served at duly received by the time of posting of the Notice and in providing Cardmember seven (7) calendar days after posting. In proving delivery it shall be sufficient to prove that the same was properly addressed and put in the post despite any evidence to the contrarypost.
