SET OFF CLAUSE. 13.1 In the event any sum of money or claim becomes recoverable from or payable by LICENSEE to the LICENSOR either against this Licence Agreement or otherwise in any manner, such money or claim can be (without restricting any right of set off for counter claim given or employed by law) deducted or adjusted against any amount or sum of money then due or which at any time thereafter may become due to the LICENCE under this Licence Agreement or any other agreement or contract between the LICENSOR and the LICENSEE.
SET OFF CLAUSE. Chemonics reserves the right of set-off against amounts payable to the Supplier under this Simplified Purchase Agreement or any other agreement the amount of any claim or refunds Chemonics may have against the Supplier.
SET OFF CLAUSE. The Organiser and/or the Manager may deduct from or set-off against any money due from the Organiser or the Manager to the Exhibitor any sum which the Exhibitor is liable to pay to the Organiser or the Manager.
SET OFF CLAUSE. “In the event of a default or breach in payment of license fee or interest amount or any other amount due with the licensee of whatever nature as per the provision of this contract, AAI is hereby authorized to adjust such amount from time to time to the fullest extent, with prior notice of 7 (seven) days to the licensee, by set off and apply any or all amount at any time held with AAI as security deposit or bank guarantee or any other amount as part of this contract or from any other expired/closed /terminated contracts of licensee with AAI. This is without prejudice to any rights and remedies available with AAI to recover the dues from licensee as prescribed by Law”.
SET OFF CLAUSE. 12.1 In the event any sum of money or claim becomes recoverable from or payable by the Universal Service Provider to the Administrator either against the Agreement or otherwise in any manner, such money or claim can be ( without restricting any right of set off for counter claim given or employed by law ) deducted or adjusted against any amount or sum of money then due or which at any time thereafter may become due to the Universal Service Provider under this Agreement or any other Agreement or Contract between the Administrator and the Universal Service Provider.
SET OFF CLAUSE. Chemonics reserves the right of set-off against amounts payable to Subcontractor under this subcontract or any other agreement the amount of any claim or refunds Chemonics may have against Subcontractor.
SET OFF CLAUSE. (i) In addition to any rights of set-off a party may have as a matter of law or otherwise, upon the occurrence of an Event of Default with respect of a party ("X") or an Illegality or Credit Event upon Merger where X is the sole Affected Party, the other party ("Y") will have the right (but will not be obliged) without prior notice to X or any other person to set off any obligation of X owing to Y (whether or not arising under this Agreement, whether or not matured, whether or not contingent and regardless of the currency, place of payment or booking office of the obligation) against any obligation of Y owing to X (whether or not arising under this Agreement, whether or not matured, whether or not contingent and regardless of the currency, place of payment or booking office of the obligation).
SET OFF CLAUSE. Chemonics reserves the right to set-off against amounts payable to Supplier under this BPA or any purchase order issued under this BPA or any other agreement the amount of any claim or refunds Chemonics may have against Supplier.
SET OFF CLAUSE. The grantee agrees that the Commonwealth may set off the amount of any state tax liability or other obligation of the grantee or its subsidiaries to the Commonwealth against any payments due the grantee under any contract with the Commonwealth.
SET OFF CLAUSE. The Vendor agrees that the County may set off the amount of any county or state tax liability or other obligation of the Vendor or its subsidiaries to the County for services performed pursuant to a Statement of Work under this Agreement against any payments due the Vendor under that Statement of Work.
