Common use of Sharing of Prosecution Costs Clause in Contracts

Sharing of Prosecution Costs. Codexis shall be responsible for all Prosecution Costs in connection with Patent Prosecution activities described in Section 9.2.1 conducted by or under authority of Codexis. If MUS conducts the Patent Prosecution activities described in Section 9.2.1 with regard to any Patent Applications and Patents that are Product Technology, Codexis shall pay to MUS fifty percent (50%) of the Prosecution Costs incurred by MUS after the Effective Date in connection with such activities. Such amounts will be paid to MUS (or its designee) within forty-five (45) days of an invoice therefore.
