Shipping and Return Clause Samples

Shipping and Return. A. You agree to ship the Artwork to the Purchaser via a common carrier as from time to time designated by us (currently FedEx) by (i) receiving a customized UGallery box sent by us, (ii) packaging the Artwork in the box, and then (iii) shipping the Artwork within forty-eight (48) hours of receiving the UGallery box. You agree to deliver the Artwork to the common carrier or arrange for the common carrier to pick up the box at your expense. B. We will pay the shipping and packaging charges directly to the common carrier and will be reimbursed by the Purchaser. C. In the event of damage in transit, we will file a claim against the common carrier and you agree to assist us. D. We will allow a Purchaser the right to return the Artwork if we are notified within seven (7) days of delivery (or as we may extend, but not more than thirty (30) days). You agree to accept the return, it being understood that you will not receive any compensation for the returned Artwork. Upon return, you agree to promptly inspect the Artwork and in the event of damage to promptly notify us in writing and retain the Artwork and all shipping materials, so we may file a claim. We will pay you fifty percent (50%) of any money we receive from any successful claim that we file with the common carrier for the Artwork. If the Purchaser damages the Artwork or does not properly package the Artwork, we will pay you for the damaged Artwork to the extent of our recovery from the Purchaser.
